JUDICIAL DECIS
ION IN VERSE.
Judge Richard B. Russell, candidate
for Chief Justice, is proltably the only
Appellate Court judge who ever wrote
a judicial decision in verse —and es
pecially verse to the Georgia mule.
When he was on the bench of the
State Court of Appeals, a Sumter coun
ty negro named Tally was convicted of
beating a mule until it died. Judge Rus
sell wrote the decision sustaining the
conviction.
In summing up his arguments for
tlie negro, feeling the lower court had
made a mistake. Attorney Howell B.
Simmons injected the following stanza
in rhyme:
“No matter how hot is the bottom
And the mule is lieset by the flies,
Let the negro at work in the cotton
Never slap with the lines if lie's wise.
Though the lines may be tight on the
nigger,
And the contract enslaves, he's a fool
If he slaps and then thinks he's bigger
In the eyes of the law than the mule.”
Judge Russell, in deciding for the
mule, could not resist the opportunity
to reply in kind, and accordingly he
• wrote.
“To this portion of the argument I
would reply in perhaps no poorer poesy,
and I think much better law :
yWhen the sun shines hot in the bot
tom,
A%l the mule is beset with the flies.
The hand and the head which guide
the poor beast
Should lie at once gentle and wise.
.The man who trusts his beast to a plow
hand —
iFor negroes and whites the law is the
same —
Is assured that the statutes anil law of
■the land
Forbid that his brute lie tortured or
maimed.
'“So where a mule’s in sole charge of
a driver,
He (no matter what color his skin)
Must show, if thnt mule should be in
jured',
That the hurt was not due td his sin.
True, the law holds the driver far
bigger
Than a conscienceless mule to be,
Yet the law should avenge with all vig
or
All drivers’ acts of wanton cruelty.”
Without assuming the v\ngracious
and thankless role of literary critic in
this grave crisis, I will sac. neveithe
less. that 1 think both Attorney Sim
mons and Judge Russell far better
versed in the law than in the wiles of

In Memory of
Doctor David Jones
Whereas, under the providence of
God, the creator of all life, we have
been called upon to mourn the loss from
our fellowship, citizenship and com
radeship in this world, the beloved
brother in the presence of I). D- Jones.
Bro. Jones was born .Ally 31. 1867.
and departed this life August 5, 1922,
aged 55 years and 5 days. He was
married to Nancy M. House, daughter
of William H. and Jane House, on
January 21, 1897. To this union was
born one child, Maggie Ruth. He is
survived by his devoted Widow and
daughter, also three brothers, two
sisters and a host of relatives and
friends, who feel keenly the departure
from this life this most highly es
tbemed husband, father, Into thee,
friend and fellow-citizen.
Bro. Jones was a liilde reader and a
believer in the Christian’s future hope.
His daily life in his home, his dealling
with his fellowmen, and his ever cheer
ful readiness to help in every call for
relief for all in need is a record of facts
which is a source of unfailing conso
lation to all who knew and survive
him.
Among his few filial words to loved
ones on earth were these: “I am at
peace with God and am ready to go to
him.” Bro. .Tones became an Odd Fel
low March 15, 1907, as a ehatrer mem
ber of Giles lodge No. 362. He was ad
mitted by card from the Beech Creek
lodge No. 121. He was beyond question
in his faithful daily life an exemplar
of all the noble and exalted principles
of Odd Fellowship.
He was given a fraternal burial by
bis beloved order, Bro. M. A. Perkins
conducting the ceremonies as Noble
Grand at Christian Chapel church on
August 6, 1922, the funeral sermon be
ing preached by Rev. Frank Jackson.
In the death of Bro. Jones, both the
Lodge and the entnire community are
called upon to sustain an irreparable
loss in his departure from our com
panionship on earth.
Bro. Jones was loyal to his country,
honest, true and a brave man. He was
a true husband and father in his fam
ily and through this love his home was
a place of unbroken happiness until
death called him away. But realizing,
as we do. that God doeth all things
well, and that in the home-going of our
most /beloved dnbther 1 , we therefore
humbly submit to his will, while we
one and all await our summons to
meet him with all our loved ones in
the home eternal.
Therefore, be it resolved, by Giles
Lodge. No. 362. I. O. O. F. that we ex
tend to Sister Jones and daughter and
.family our sincere sympathy in their
sorrow, and pray God's comfort and
healing of their hearts, and that in
the home of many mansions they shall
meet again where all sorrows, pain
and tears shall have forever passed
away.
Resolved, further, that these resolu
tions be sent to the Winder News for
publication and a copy of same be sent
to our beloved Sister Jones and daugh
ter, Maggie Ruth.
