Or Less.
An amusing case of tresspass, was
decided in our County Court a few days
ago, which was related to us about as
follows
A gentVcnWn sold to his brother a
small piece of laud wiio sold it to a
third fcaVly. ,some difference arose
between tlie third pnr ( ty and the first
owner of the land. In consequepe of
which two feneps were built, leaving a
narroiv lane between them. Some
time afterwards thepnrty tvli'b purchas
ed tlie jriece discovered that his
deed called for an “acre iiiore or less,”
whereas he extends his fence and takes
in more land, appropriating both fen
ces, and nioVecl ins neighbors’ fence to
Another portion of his plantation.
(3rie of the witnesses testified that the
fence ran "North and East,” arid- was
interogated as follows :
‘Mr.—— built bis fence first, did’nt
lie?’.
“Y'A? sir.”
“ He ni®vod bis fence aftebwndrs,
dind’nt lie ?”
“Yes sir, he did,”
“Well, did lie give any reason for
moving it and taking the other fence."
“JFell, yes sir; he said that he dis
covered that his deed called for an acre
more or less, and so he extended liis
fence to take in more land, and the
btljbf 1 fence being on the "more part”
of his land, he took it tod.”
The jury found in favoi' the defend
ent;
The man who comes out and advo
cates anew and better system ior work
ing our public roads, should be sent to
the legislature. The present road law
lias been thoroughly tested and has
proven to be a miserable failure, and
should he wiped out and anew plan
enaugurnted. Each county might util
ise It! bivfi convicts to an advantage
on its roads. It ftbiltd be better to levy
a small road tax, than to summons
Hands to work, as is now done, who
liij- inbound in the shade, tell tales and
scuffle, and put In Rbolit half time. One
or more overseers could be appointed
or elected in each district, to employ
hands to work the roads, as yoii would
any other jo’H of work. Ihe Work
Should be inspected and received, ii
jifopperly executed, and ordered paid
for olit the road funds. Contracts for
working public roads might be let to
lowest bidder, with certain specifica
tions if necesssary, tlie same as the
ibttlhg of liMdges and other Jiiiblic
wor’iL There are various devices, it'
seems to us, 1)01101 than the present
one for working the roads. Wc don’t
think tii.lt iny plan cari be inaugura
ted that will be worse than the present
lawon this subject, and farmers, in par ;
ticular, ought to be more interested
behaving good roads than any one Use.

Tlie billowing decision wits render

who are furnishing supplies on time
and taking deeds and waiver notes
for the sainej under tlie impression
that a deed Riven for security of the
payment of quiver notes, conveys
with il the title-to lands thus deeded,
it is well for thein to, kiiow that a
deed has been declared of no higher
dimity than a inortgnge and carries
ho P title with it. The following is tl o
