HABEAS CORPUS
IS DENIED MORSE
Atlanta, (in.., June 28. —Charles
W. Morse today failed in his effort
to obtain bis release from the fed
eral penitentiary on a writ of ha
beas corpus.
Without passing upon the validi
ty of that portion of Morse’s fifteen
years beyond ten years, District
Judge Newman denied the petition
for a writ, declaring that ten years
of the sentence unquestionably was
good and, as Morse had not served
out that time, the court had no
right to enter further into the mat
ter.
Morse’s attorneys filed notice of
an appeal to the circuit court of ap
peals of the fifth circuit. Judge
Newman said that he had no doubt
as to the legality of Morse’s con
finement in the Atlanta prison, al
though it had been erected for
“hard labor” convicts. He said
<%at Morse might be able to ob
tain a transfer to another prison by
application to the attorney general,
but thought conditions here proba
bly were as good at least as would
be found in a prison elsewhere. He
did not suppose there was a prison
anywhere where the prisoners did
not have some work to do, and
thought it would lie bad for them,
if such were the case. In closing
his argument in behalf of Morse,
Attorney Arnold said he wanted the
court to determine the exact status
of his client. He contended that,
as Morse had been illegally sent
enced to fifteen years imprisonment,
when ten years was the maximum
on one count, the entire sentence
was void. He cited numerous au
thorities in support of his conten
tion that Morse could not be sent
enced legally in gross, admitting
that this point never had been
passed on by the supreme court.
He said that there was no doubt
that Morse could obtain his release
on a habeas corpus *%rit after he
had served ten years of his sentence,

mayor and city council are adver
tising a local bill amending the
charter of the city to allow the may

the matter of street paving, build
ing of si lews) Iks, and city property.
It is the intention of the present
city officials to propose a bond is
sue of 875,000, to be used exclu
sively for the purpose of paving all
the principal business streets of the
city, but before this can be done the
city charter must be amended so as
to allow the city authorities the
power to force the property owners
to pave certain portions of the
street.
Many other improvements are be
ing planned, among them the sale
of the present city hall and to re
build on the property' owned by the
city, facing Seventh street, a hand
some building, to cost $40,000 —Ma-
