State and Federal Courts—An Im
pcrtant Case.
Judge Gibson, of the Augusta circuit,
is about to put to the test the power and
authority of the federal circuit court.
Ile was recently requested to certify a
certain case to the United .States court,
hilt ho refused on the ground that the
case had been already appealed to the
supreme court of the .tate. acd that the
federal court had act jurisdiction. 1 he
case and facts are about as follows :
Judge Schley and wife ft at., vs. John
IV. f arewell, executor of Baldwin B.
Miller. A writ of certiorari having been
isaneil by Judge Krskine in tie- above
stated case to Judge Wm. (iihson, of the
Augusta circuit, requiring him to send
the record from Burke superior court,
from which court the case had been re
moved on complainant’s petition, which
he declined to obey for reasons stated in
bis return. Associate Justice Bradley,
of the United States supreme court,
after consideration of the reasons, ad
judged the same insufficient, and ordered
the clerk to issue an altar writ, return
able forthwith.

A singular incident is reported from
lower GormU, in Worcestershire, Eng
land. A party of I'eople were returning

swarmed with them for a distance of
