24th, 18HH. In re eon test proceedings of the election for I'eiiiovnl of
county site of Wilcox county. The demurrer or motion to dismi-s. filed
by contestees is overruled. The principal ground of same was that the
notice'of contest did not show wlmt ballots were cl, time I ns illegal. The
legislature Inis frequently passed upon this question, and -,<> far a. I have
been able to find from the record of legislative contest eases, it hits been
invariably held not to be a good ground. The same question was also
made liefore (ioveruor (lordon during the time the governor determined
contest eases between county ollieers, ami in the ease of McFnrlcn v.
Foster, which is reported in 82 (in. S1 .*{, the'motion to dismiss upon this
ground was overruled.
The face of the returns gives for removal, 2.128 votes. The eonhes
tants concede as illegal thirty-seven votes. The proof clearly shows ille
gal. in addition to these, forty-nine votes, leaving lor removal 2.U I2 votes

concede as illegal Uhl votes, The evidence clearly shows, in addition
these. 12d votes; leaving against removal 1,010 votes.
In addition to the above, it appears that forty-nine persons are re
corded as voting at the Abbeville prectnet against removal, and the same
persons are also recorded as voting for removal at their respective home
preciwr ts. Not being able to determine from the evidence which are the
illegal votes, and as the evidence shows fraud on both sides. I think it
right and proper to deduct, these foi ls nine voles from both for removal
and against removal, leaving for removal I,!•!).'! votes, against removal

I, William Clifton, secretary of state, hereby certify that an election
for removal of the county site of Wilcox county was duly held on the 10th
day of November, 1H1I7. and Unit two thirds of the qualified voters voting
at such election voted in favor of removal of the county site from Abbe
ville to Kochelle, to wit:

To The Georgia Legislature.
The Wilcox Court House issue is
now about to be tried by a jury of
citizens from the one hundred and
forty counties, more or less, of our
great commonwealth. And in order
that you may act justly to all, the
following points are presented by
one who has no prejudices and no
• ‘axe to grind.
First, this is more of a struggle
between two towns than two sides of
:i comity. Let. the motion be to put
the court bouse in the woods and
though it be the centre, the motion
would fail for the want of sup
porters. The men who furnish the
money to move the court house have
more private ends to gain than pub
lic ones, It is property in a corpo
ration rather than philanthropy for
the majority of citizens.
Second, the movers of the court
house have left no “stones uti
turued,” either foul or fair, and
those who have acted on the defen
sive in keeping said court house
have simply “fought lire with lire.
If default or defect has been prac
ticed at the polls of one it has also
been done at the other. And cer
tainly the removal party did resort
to threats, force of arms aiul intimi
ilntion at certain places which the
defensive did not.
Third. If it is an outrage for
Wilcox to have-the court house to
one side of the county then
of other counties are in the same di
lemma. Take your map and see
the comities that have court houses
in the centre, or near it. They can
be counted on your fingers that are
built so as to be equally accessible
to till the* people. TJie Capital ques

Fourth. If your tribunal should
deeide like our Secret a rj of State
Ims-done, that Wilcox's court house
should be moved to Rochelle, a pre
cidetil will be set and a war of court
house removals will begin, which
will keep your body busy for years
to conic. In these times of unrest
and agitation there ought to be
something settled and permanent to
act as an anchor for the people, and
where would be a better example
than tlm House of Justice. If so

Last, if your body must act in a
radical way. but not favorable to the
defensive party, might it not be best
for all parties, to lay this matter on
