Tuesday night was the time set by the council to try the Mitchell mill pond case, the pond having been condemned some time ago by tbe Board of Health. As Judge Fort was disqualified, E. G. Sim mons, attorney for Mr. Mitcbell, went down to Albany, Tuesday, to get Juuge Bower to issue an injunc tion restraining the council from trying the case. Judge Bower listened to tbe plea, and gave a re- straining order, stopping the coun cil from trying it, and setting the time to bear the case on Tuesday, 28th, at Isabella, when he would decide whether to issue an injunc tion or not. A telegram was sent to Mayor Felder, telling bim not to try the case, and tbe necessary papers would be forwarded on next mail. Thursday morning tbe council met in consultation with Judge Hawkins, tbeir attorney, and de cided to make out tbe necessary papers and let the Judge go down at night and try and have tbe or der modified to let the council try tbe case. In any event it seems that tbe case will go to tbe Supreme Ceurt, as both sides are determined to' fight it to the last. So far as the council is concerned, all they wish to do is try the case on its merits, if it can be proven that the pond \ is not unhealthy and does not OOTTOM’ cause sickness, they do not wish to condemn and break it. But in justice to tbe people of Americus, it is theit duty to see that no cause for great sickness is allowed to lie open in the city it it can be re‘ moved. As for the council saying that they are determined to break tbe pond, that is all nonsense, as not a member Iras expressed an opinion either way. New Advertisements. OPERA HOUSE.
