may get a new trial. The motion

The Application of the Attorneys for
Woman for a Writ of Habeas Cor
pus—Accomplice Will Also Pay the
Same Penalty as Principal.
Kansas City, Jan. 4.—Judge John
Philips, in the United States district
court here Friday denied the appli
cation of the attorneys for Mrs. Aa-
gte Myers for a writ of baboas corpus.
This means that Mrs. Myers, who
is now in ail at Liberty under sen'
tence of death for the murder of her
husband, and Frank Bottman, in jail
at Kansas City for complicity in the
crime, will be executed on January
10, unless Governor Folk interferes.
The attorneys of Mrs. Aggie Myers
said they would, on Monday next,
file an appeal to the United States
supreme court,' from the decision of
United States District Judge Phil
lips, who Friday refused to grant a
writ of habeas corpus. It is their In
tention to get the appeal in so late
that the United States supreme court
cannot act upon it earlier than nine
months, or at it* next term.
As a last resort the attorneys for
Mrs. Myers and Holtman will now
appeal to Governor Folk to commute
the sentences of the prisoners to life
Imprisonment.
