Indianian Gets Second
Place by Acclaim
DENVER, COL, July 10.—(Special)
—Bryan and Kern.
Tills Is the Democratic Presidential
ticket as made out today.
Brvan was nominated at daylight
this morning, after an allnight ses
sion. The vote stood:
Brvan 89214;
Johnson 46;
Gray 59Yt-
Georgia's vote was: Gray 20; Bryan
4; Johnson 2.
John W. Kern, of Indiana, was plac
ed In nomination for the Vlce-Presl-
denev by Thomas Marshall, of Iowa,
seconded by Gov. Folk, of Missouri.
New York and a number of other
state also seconded the nomination,
It was Kern from the start. Judge
Gray sent a telegram declining to be
considered for second place. J. T.
Hill nominated Clark Howell. but
withdrew nomination. Kern was nom
inated by acclamation at 4 o'clock
this afternoon.
The platform was adopted practi
cally}' as published. The anti-injunc
tion plank Is said to be satisfactory to
Gompers and the labor leaders. In
industrial disputes It declares all

parties to judicial proceedings shall
be treated with rigid Impartiality, and
that injunctions shall not Issue
any cases In which injunctions would
not Issue If Industrial disputes were
not Involved.
Kern was the Democratic candidate
for Governor of Indiana In 1904, being
defeated by Gov. Henly. The vote
was: Kern, 274,998; Hanley, 359,362.
The nomination of Kern was some
what unexpected, his name not hav
ing been promtnently mentioned until
today.

SHIPPING OF FRUIT
With yesterday the shipping season
at the large Baglcy-Ray-Gober Or
chard near Americus came to an
end. and the large force employed
there during the past month, packing
and shipping peaches, has gone else
where for similar work.
The season was a successful one,
and the company, doubtless, Is pleas
ed with results.
Fifty carloads peaches were ship
ped from this orchard since the sea
son opened In June, and for a first
year’s work the results are probably
quite gratifying.
This orchard, first or second In size
In the world, with more than four
hundred thousand trees, made Its
first shipment upon a large scale this
year, when probably 150,000 trees
came into bearing.
As a rule, the shipments brought
good prices in the north, and from a
financial standpoint the results are
satisfactory.
The last of the fifty cars went for
ward yesterday.

“Public Place” is Defined
By Higher Tribunal.
While Americus has had no viola
tion of the prohibition law as yet,
there is interest here In what is per
haps the most Important judicial In
terpretation yet placed upon the state
prohlbtion law enacted last year,
contained in the decision handed
down by the court of appeals In the
case of Took vs. the State.
The decision states what Is a “pub
lic place" within the purview of the
prohibition law.
It declares that a man's house, his
club, private office, or room In a ho
tel, while not prlma facie a public
place, may become so. A man may
extend the courtesy of a drink to a
friend in any of these places, hut If
any such place shall be open Indis
criminately to the public, it becomes a
public place.
Liquor or beer may be served at a
dinner or barbecue, if It Is an enter
tainment given on a special occasion
to a select list of guests; but If any
such entertainment becomes a per
manent institution, it violates the pro
hibition law.
The case which resulted in the court
of appeals clearing up various un
certainties as to a citizen's rights and
privileges under the prohibition law,
was that of Charlie Took, a prisoner
convicted of selling a drink of whisky
to a fellow prisoner, David Hill, In
the Oglethorpe jail in Macon county.
The case was appealed from the city
court of Oglethorpe.

PYTHIANS IN FORCE TO
COME TO THE MEETING
The colored grand lodge of the
state, Knights of Pythias, will meet
In Americus next week with a very-
large attendance, and colored citi
zens here are busy in preparation for
the occasion, and, to the end of tak
ing care of the -delegates.
Two thousand of these, It Is said,
will attend the session.
The opening ceremonies will take
place on Monday night at Bethesda
Baptist church, where addresses of
welcome and response will form part
of the program.
The city council, hoard of trade
and others of the white citizenry have
been Invited to attend the exercises
at the church.
An Important feature of this
meeting of the grand lodge will be
that of determining tile location of
the Pythian Home of the Grand Lodge.
Americus and "Macon are the places
under consideration, and one of
these may he selected at this meet
ing.
The proposed building and grounds
will cost about $75,000, and the lod
ges both In Macon and Americus art?
