The most interesting trial at the
temple here In some time was the
committal bearing given the two white
men, J. L. Brett and Martin High
tower, Jailed .here a week ago upon
the charge of vagrancy, to which' the
charge of simple larceny was added
several days later.
| "The woman in the case” turned
state's witness, and her testimony re
sulted In the holding of the two men,
one of them alleged to be her
brother, in $300 bond.
| They were both bound over to the
next term of the city court.
| The committal trial before Judge
t Crisp yesterday grew out of the theft
of a drummer's sample trunk from
the Central railway depot here sev-
, eral nights ago, a large part of the
contents of fine goods being found
at the house of the woman by the
officers.
' This consisted largely of fine hoa.
lery and fancy goods. The smashed
, trunk was found In the grove near the
station.
| The sheriff afid police department
have been busy on the case for four
days and were fully ready when the
three prisoners were arraigned for
trial.
I To the surprise of the men. the wo
man, Emma Hightower, a fair denizen
of "the bottom” kiere, told the court
that her alleged brother, Martin High
tower, and J- I* Brett, brought the
stolen goods to her for safe keeping,
stating that they fcta-d bought them.

. favor of the state and against the
alleged trunk snatchers.
The two men disdained legal as.
slstance and conducted their case In
a masterly manner, carefully qulz-

I testified against them. But the bur-
, den of proof seemed against them anS

each of the men.

Secretary of the Navy Meyer has
declined to approve the adverse re
port of a naval examining board on
the application of Lieut. C. P. Burt,
of Georgia, for promotion to the rank
of lieutenant commander. Had the
report been approved, Lieutenant Burt
would have been dismissed from the
navy, with no chance for a restora
tion.
Senator Bacon's Influence and inter
est saved Burt the humiliation of dis
missal. The senator’s Interest was I
prompted by Ms absolute confidence
in the belief that a Georgian was 1
about to suffer an Injustice. i
Instead of approving the report, the
secretary haa given the officer one
year in which to prepare for another!
examination for promotion to the
rank of lieutenant commander.
Lieut. Burt Is the son of the late
Dr. W. P. Burt, of Americus. .Ho
graduated from the Annapolis naval'
academy In 1896 as a steam engineer
and has since advanced to his pre3-'
ent rank, with a salary of $2,600 per
year.
The examining board found Lluot.
Burt deficient only in practical navi
gation. He is an engineer and has
had no actual experience as a naviga
tor, which explains this deficiency.
The board also found against nls
moral character as affected by th<e
charge that he does not pay his
debts. The unfairness of the charge,
and the conclusions of the board were
developed by Senator Bacon In his
brief, which; showed also the admira
ble record Burt has made as an of
ficer of the navy.
Lieut. Burt was chief engineer on
the battleship Georgia from Ports
mouth to San Francisco, and thence
to Manila. He is now in Washing
ton.
