Conduct giving such
rise to said seizure was
as follows: In February of
2021, Sgt. Keith Kendrick of
the Lamar County Sher
iff’s Office began a drug
investigation related to
illegal drugs being sold by
Eddie Lee Miller in Lamar
County, Georgia. On April
19, 2021, a confidential and
reliable informant met with
Sgt. Kendrick and stated
that they could purchase
methamphetamine from Ed
die Lee Miller. A controlled
drug transaction took place
subsequently where the
confidential informant pur
chased suspected metham
phetamine from Mr. Miller at
his residence, located at 117
Highway 41 North, Lot 46 in
Barnesville, Lamar County,
Georgia, using currency pro
vided by Sgt. Kendrick. The
confidential informant told
Sgt. Kendrick that Mr. Miller
has also delivered metham
phetamine to them in his
Honda vehicle and also in
his pick-up truck. A search
warrant was procured by
Sgt. Kendrick on April 20,
2021, for Mr. Miller’s resi
dence. The search warrant
was executed on April 29,
2021. Inside of the residence
was found suspected co
caine, marijuana and meth
amphetamine. A sum of
United States currency was
found on Mr. Miller and in
side of the residence. When
speaking with the deputies,
Mr. Miller made a litany of
incriminating statements.
For example, he showed the
deputies where illegal drugs
could be found in his house.
He stated that he was a
“hustler.” He stated that
the cash found in the house
was “money from hustling.”
Finally, Mr. Miller admitted
that he sold illegal drugs
from his residence, but that
he would not tell the depu
ties from whom he received
the controlled substances.
The narcotics found in the
house were packaged for re
sale and the deputies found
other drug paraphernalia in
the house as well. The prop
erty (cash and two vehicles)
were ultimately seized by
Sgt. Kendrick in Lamar
County on April 29, 2021.
The Defendant was charged
with Possession of Meth
amphetamine with Intent
to Distribute, Possession
of Cocaine with Intent to
Distribute, and Possession
of Marijuana with Intent to
Distribute.
Claimants who may have
an interest in said property
are EDDIE LEE MILLER. Said
property was used in viola
tion of O.C.G.A. § 9-16-1 et.
seq., and 16-13-49 et. seq. in
that the item(s) was/were
used to facilitate the posses
sion, sale, and distribution
of controlled substances
and/or marijuana and/or are
proceeds derived or real
ized therefrom and that said
item was used directly or
indirectly used or intended
for use in any manner to
facilitate a violation of
O.C.G.A. Title 16, or of the
laws of the United States
or of any State relating to
marijuana/controlled sub
stance which is punishable
by imprisonment of more
than one year, and or said
property was found in close
proximity to controlled sub
stances and/or marijuana.

deputies with the Lamar
County Sheriff’s Office to
the residence by land. One
of those deputies was Sgt.
Keith Kendrick, who was
directed to 947 Van Buren
Road - the residence of
Nathaniel Gilbert. Sgt. Ken
drick met with Mr. Gilbert,
who told Sgt. Kendrick that

he knew why he was there.
Mr. Gilbert explained that
the “guys in the helicopter”
saw his marijuana plants
from the sky and Mr. Gilbert
consented to a search of his
property so that he could
show Sgt. Kendrick “every
thing.” The search produced
at least eight (8) marijuana
plants growing from the
ground. Mr. Gilbert stated
that he himself planted the
marijuana plants and that
he watered and fertilized
them. Mr. Gilbert stated that
he grows marijuana so that
he “does not have to buy it
on the street.” Mr. Gilbert
also showed Sgt. Kendrick
marijuana that he had
stored in his house along
with a shotgun. Mr. Gilbert
also allowed the deputies
to search his 2005 Chrysler
300 vehicle. Inside of the
trunk of the vehicle was
stored plant food, which
Mr. Gilbert admitted that he
used to feed his marijuana
plants. The vehicle was
ultimately seized by Sgt.
Kendrick in Lamar County
on May 19, 2021. Mr. Gil
bert was charged with the
manufacture of marijuana,
possession of marijuana
and possession of a firearm
during the commission of a
crime.
Claimants who may have
an interest in said property
are NATHANIEL GILBERT.
Said property was used in
violation of O.C.G.A. § 9-16-1
et. seq., and 16-13-49 et. seq.
in that the item(s) was/were
used to facilitate the posses

Conduct giving such
rise to said seizure was as
follows: On April 22, 2021,
Sgt. Mike Brayton of the
Lamar County Sheriff’s Of
fice conducted a traffic stop
on Interstate 75 in Lamar
County on a vehicle driven
by Leo Chong Moon for
following another vehicle at
an unsafe distance. Brandon
Michael Cainion was a pas
senger in the vehicle. Mr.
Moon was initially unable to
produce his driver’s license
and both Mr. Moon and Mr.
Cainion’s demeanor was
that of extreme nervous
ness. While speaking with
the men, Sgt. Brayton could
smell the odor of marijuana
from inside of the vehicle
and he also noticed suspect
ed loose marijuana on Mr.
Cainion’s clothing. Mr. Cain
ion admitted that there was
marijuana in the vehicle and
handed Sgt. Brayton a bag
of suspected marijuana. Sgt.
Brayton informed Mr. Moon
that he would be conduct
ing a probable cause search
of the vehicle and Mr. Moon
admitted that there was
additional marijuana and
United States currency in
the vehicle. Sgt. Brayton
found additional vacuum
sealed bags of suspected
marijuana and $7,778.48 of
United States currency in
close proximity. The cash
was packaged in banded
bundles consistent with that
used in drug transactions.
Additional marijuana was
found hidden in Mr. Cain
ion’s underwear. Finally, a
book bag was searched and
inside of it was found eleven
(11) suspected alprazolam
pills and three (3) suspect
ed Vyvanse pills. Neither
man had a prescription for
the pills. The United States
currency was ultimately
seized by Sgt. Brayton in
Lamar County on April 22,
2021. Mr. Moon has a previ
ous felony drug conviction
in the State of Georgia. The
men were charged with
Possession with intent to
Distribute Marijuana and
Possession of a Controlled
Substances.
Claimants who may have
an interest in said property
are LEO CHONG MOON and
BRANDON MICHAEL CAIN
ION. Said property was used
in violation of O.C.G.A. §
9-16-1 et. seq., and 16-13-49
et. seq. in that the item(s)
was/were used to facilitate
the possession, sale, and
distribution of controlled
substances and/or mari
juana and/or are proceeds
derived or realized there
from and that said item was
used directly or indirectly
