This etise !as heon long alul bitterly contested both in the state and federal courts. j The case was first brought in the : Johnson county superior court, and then transferred to the United States circuit court, at the insurance company. After a lengthy trial in the United i States circuit court, in which the insurance company set up f and on the part of the insured—clainiiiu: that the special agent of the com pany and A- A. Pullen, the sou of ihe insured, substituted a ILOOttO policy for a $5.000 —and that, .1. H. Pullen, the insured, had consumption at the time the application was made and at the time the policy was issued— that, in fact his death was due to con sum pt ion. Judge Speer, in deciding the case, reviewed all Ihe various statements lof witnesses on both sides of the ease and found that the contention of the insurance company was no I sustained b.v the evidence. He held that where there is an in contestable clause embodied in an insurance policy, which forms part i of the contract between the company and the policy holder, that a claim of fraud will not lie as a defense against payment, after the company had ample time during (he life of t lie deceased to show fraud will not. ..k a defense against payment, after tlie company had ample time dur ing the life of the deceased to show fraud and cancel the policy.
