Cummins, the former Nashville pro moter, who v.as fouuil guilty yesterday of grand larceney? but before that time his attorneys expect to perfect plans by which ho will bo able to temporarily a£ least keep out of prU on. The Jury decided that Cummins took for his own use $140,000 deposit ed with the Carnegie Trust Company, which he practically controlled, as a fuml to be held in trust for several other banks. This Is the second conviction grow- ing out of criminal suits that followed the collapse of the Carnegie Trust Company. The first - of Cummins’ associates found guilty was Joseph B. Reichmann, president of the company, vho was convicted of making false returns to the state banking depart ment. Relchman secured a certifi cate of reasonable doubt and is now at liberty pending appeal Cummins' it is expected will attempt to get sim liar relief. If the certificate is de nied he will have to go to Jail until the higher courts settle hi* fate. The third trial resulting from the Carnegie Trust tangle will be that of Charles H. Hydo, former city cham berlain, who is under indictment for bribery. It is chargod that through his control of the city's deposits ho forced the Northern Bank to lend the Carnegie Trust Company $130,000 to his own personal gain. The district attorney says that he will ftovo to havo the dnte of Hyde’s trial set on Friday, when Cummins is arrangod for sentence. WIFE CALLS FAUST INSANE. Special To The Herald. St. Louis, Mo., Nov. 21.—An Inquiry into the mental condition of Anthony R. Faust, a wealthy restauranfeur known as "Tony” Faust, was begun today before Judge Holtcamp in the Probate Court. The Inquiry is the result of chargos made by Mm. Faust,, who alleges that her husband Is indane and incapable of looking after his buslndss affairs. Other members of the Faust family agree with the wife that Mr. Faust is insane. In the opinion of the medi cal experts, it Is said, Mr. Faust h»« been afflicted with acute paresis for several months. "Tony” Faust Is one of tfio best known men In St. Louis. He is the son of the lato Anthony Faust and a brother of Edward Faust, vice presi dent of the Anheuser-Busch Brewing Company.
