The fine was paid and Neal left the
state.
THE SENTENCE REINFORCED,
Subscquently, when it appearsd that
the grand jury had indictea the prisoner
for a repetition of the same offense,
Judge Fite ordered that the sentence of
six months’ imprisonmeun’ be carried
out,
This order was vesisted on several
grounds, one of them being that the
judge could not suspend a sentence and
then enforce it. Another was that six
'months had elapsed after payment of the
fine,
The supreme court, in Its decision
handed down today, holds'that a judge
cannot impose sentence and suspend it,
AGAINST PUBLIC POLICY.
This is interesting mainly for two rea
sons. First, it 1s by many considered
against public policy to have alternative
fine penalties where the officers of the
court get the fees. This question was
presented to the lezislature by Govern v
Northen, who'said that alternitive pen
alties were the source of much rotten
ness,
Second, there are under! conviction
with suspended sentences a number of
prominent citizens of Daltn, indicted
of complicity in the systematic train
robbery at that plac:. Unader this de
cision their sentences will have to be ex-

ecuted and a number of them may go to
the penitentiary.
This question is one of far reaching
importance, and has been the subject of
much political agitation: Following the
message of Governor Northen, the popu
lists tock it up in the campaign of 1896
and their position, as well as that ot
(fovernor Northen, seems to have been
sustained by the supreme court.

An escaped convict named Oliver at
tempted to assault the person of Mrs, T.

ty. When the negro attacked Mrs.
Drake she was in the, yard and ram into
the bouse and secured her husband’s
pistol, but in the strugule he wrenched
the pistol from her and ran. While
ipassing the mill of Cochran & Co. he
shot at another negro, He was followed
by a searching party, who captured him
and tied him to a tree and riddled him
with bullets,
There is ro question as to Oliver being
the man who attempted the rape, as the
pistol was found on his person w~hen
(caught and identified by Mr. Drake as
