Important Decision.
The decision of the Supremo Court
of the United States, ns regards tram— ,
actions in Conledernta money, is re
ported to the Associated Press as fol
lows ;
Washington, November 1 —The
Supreme Court in the case of Thoring
ton vs. Smythe & Hartley, from Ala
bama, reversed the decision of the
Court below, and the case was reman
ds for anew trial. This derision
pjves validity to obligations wi bin the
Confederacy, computing dollars at the
Value of Confederate notes at the time
th« obligation was incurred.
A fuller statement of the case of
Thorington vs. Smythe & Hartley, on
ft bill in equity for the enforcement of
the vended* lien: Smvthe & Hartley
purchased Thorington-s land and gave
their promissory note for part pay.—
Trie transaction occurred in 1364
Without modifying circumstances,
Tho. ington would ho entitled to a de
cree lor tho amount and r terest. The
defence pleaded that only Confederate
notes were current. The land was
worth only three thousand dollars in
real money. The contract price was
forty five thousand dollars thirty five
thousand v\ hereof was actually paid in
Confederate notes, anil a note for the
remaining ten thousand was to lie dis
charged in the same manner, and it is
claimed cn this state of facts that the
vender is entitled to no relief in the
United States Court, which claim was
sustained hy the court below, and the
cuso was dismissed.
The questions before the Supreme
Court upon an appeal are: First —Cun
a contract for tire payment of Conled
crate notes, nude during the lute re
bellion, between parties residing within
the so called Con.e ieraie Slates, be en
force i at all in the courts of the Uni
ted States? Second—Can evidence
be received to prove that a promise ex
pressed, ekou'd be for the payment of
any other than lawful dollars of the
United States ? Ttnrd Hoes the ev
ideiice in the record establish the lact
that the note for 810,000 was to be
paid, by agreement of the parties, >n
Confederate notis?
The first question is answered affirm
atively. The second question is an
gered affirmatively, with the follow
ing remarks: We art' c early of the
opinion that such evidence must be re
ceived in respect to such a contract, in
order that justice may lie done be
tween the parlies, and that the party
entitled to be paid in these Confederate
dollars can only receive their actual
value at the time and place of the con
tract, in lawful money of ttie United
Stales. On the third question the
Court says: We do not tnink it neces
sary to go into a detailed examination
of the evidence. It is enough to say
that it tins left no doubt in our minds,
that the note for ten thousand dollars
--to enforce payment of which suit
was brought in the Ciicuit Court—was
to he paid, by agreement of tbe parties,
in Confederate notes.
