ly devised scheme cf relief which had
been incorporated in it, will feel an in
terest to know the extent of the ,Cnn«.
gresaiooal eunseulaticn to which it has
been subjected by the Senate Judicia
ry Committee, we print bejow that por
tion of tho Constitution that has been
stricken out. By reference to tbc dis
patch which wo published yesterday, it
will be seen that the Judiciary Commit
tee have, in their amendment of the
Omnibus Admission Bill, roommended
tho striking out the first and third sub
divisions of the XVilth section of the
new Constitution, with the exception
of the proviso to the first eub.divisioo,
which has refcreuco to oontraets based
upon 6lavo property. Wo append the
sub divisions referred to, with the pro -
viso which is retained.
SECTION XVH.
1. No court in this State shall have ju
risdiction to try cr determine any suit
agaiust any resident of this State, upon
any con’raec made in renewal of any
debt existing prior to tho first day of
June, 1865. Nor shall any court or
ministerial officer of this State have au
thority to enforce any judgement, exe
cution or decree, rendered or issued up
on any contract in renewal of a deb*, ex
isting prior to the first day of June,
1805,.except in tho following ease :
1. In suits against trfetecs where the
property is in the hands of the trustee,
or has been invested by him in other
specific effects now in bis hands, and in
suits by the vendor of the real estate
against the vendee, where not more
than one third of the purchase money
has been paid, and the vendee is in pos
session of the land or specific effects for
which he has sold if, and be refuses to
deliver the land and said effects to the
vendor. Iu such coses the courts and
officers may entertain jurisdiction and
enforce judgement against said trust
property or land or cff"ot».
2 In suits for the bent fit cf minors
by trust-es aproint and before the fiir
day of June, 1865.
3. In suits against corpo rat ions in
tbeir corporate capac ty, but not so a*
to enforce the dtfbt aga'nst the stock -
hobdera or officers thereof in tlreir indi
vidual capacity.
4 In suits by charitable or literary
institutions f,T money loaned, property
—-other than slaves—s >IU, or services
rendered by such itu*}itqtions
5 Iu suits on dob's duo far median
teal or manual labor, when suit is by
the mechanic or laborer.
6. In oases where the and. bt is set up
by way of defense, and the and bt set up
exceeds any debt duo by dofendent to
plaintiff of which Courts are denied ju
risdiction.
7. Iu all other cases in which the
Geaeiil a-sembly shall by law give the
said courts and officers juriedictioa.—
Provided, that no cer.rt cr officer shall
have, nor stigll the Geniral Assembly
give juiisdiction or authority to try or
give judgement-on or enforce any debt,
the consideration of which was a slave
or slaves or the hire thtreof.
11l It shall boio the power of the
General Assembly to assess and cof
leet, upon all debt*, judgements, or
causes of actions, when due, founded on
any contract mado, or implied, before
the first day of Juue, 18C5, in the lands
of any one in his owu right, or trustee,
agent or attorney of another, on or after
the first day of January, 1868, a tax cl
not exceeding‘2s per cent., lobe paid
by the creditor on pain of the forfeit
ure of the debt, but chargeable by him,
as to one half thereof, against the d< bt
or, and collected with the debt; Prout
did, that this tax shall not be collided
if the debt or cause of action be abap
dimcd or settled without legal process,
or if in judgement, be settled without
levy and sale, and provided further,
this tsx shall not be levied on so long
as the Courts of this State shall not
have jurisdiction of such debts or causes
of action.
The recommendation of the Judiciary
Committe will no donbt bo adopted by
Congress, who could not do less than
reject a provision In the State" Consti
tion so dercctly in conflict with the
Constitution of the United States.—
None knew beltor than tbe framers of
Constitution themselves that tho pro
posed relief was fallacious, and that if
not r.jeeted by Congress it would eer
triuiy bo overruled by the Courts. But
as the Macon Telegraph remarks, “it
has already accomplishcnfd the object
they mads it for—it has seduced a good
many simple people into voting for the
Cocstitntioo, and as their votes cannot
be recalled no matter whether “Relief"
stands or not, the end has been accom
plished.”
After all Joe Brown’s promises of
relief, the now Constitution repudiates
| what we had already been forced to re
pudiate the debts incurred iu aid of
the war for secession.

in position they were perfectly cool and

friends atid carried to the boat. All
hands then re-embarked, and in a short,
time arrived in the city. Brandt was
was placed in a cart and conveyed to
bin home, on the corner of South broad,
and Reynolds street. He was badly
wounded in both legs, and iu the groin
and thighs, the shot having scattered
considerably. Eight shot struck him,
and one of them cot a large artery,
which caused him to bleed profusely.
Drs. Bulloch and Marrisson were
called to attend him, but dispite the
skill of the physicians, he bled to death.
He expired at about fifteen minutes be
fore twelve o’clock. Both of Brandt's
formal arteries were revered by the
shot.

diet : “Deceased came to bis death
from a gun shot wound from the hands
of Eugene Morehead, in a duel, on the
Sou'h Carolina shore.*
Deceased was about thirty-five years

Mr Buchanan’s Last Illness.—
