A case of peculiar interest was
that, of Mack 1 lllliarfl, a negro la-j
borer, who lmd been indicted by the
grand jury of Telfair county on the
c harge of giving a drink of liquor
to a white hoy eighteen years of
age. The liquor eras given to the
boy last Christmas day, in the pres
ence of the boy’s father, and the
negro swore that the boy’s father
asked him (the defendant) to give
the boy a drink and the boy also
swore upon the stand in the trial of
the case that he heard his lather tell
the negro to give him (the boy) a
drink of liquor. The hoy’s father
was a section master upon the rail
road, and Mack Hilliard, the negro
on trial, was a laborer under the
section master. Hut Solicitor Gen
eral Smith plead that the boy was a
minor, and the law strictly prohibits
the giving, selling or furnishing
liquor to a minor without the writ
ten consent of his parent or guard
ian. The authority must be given
in writing. It was an unusual case,
and the negro had the sympathy of
the citizens generally. Judge Kib-
bee’s charge to the jury was very
plain, and in strict conformity with
the law. The jury brought in a ver
dict of guilty, with a recommenda
tion to mercy. Judge Kibbee sent
enced tbe man to six months in
the chaingang, at hard labor, or re
lieve himself by paying a fine of
five dollars and costs. The sent
ence of the court met the approba
tion of the citizens, though some
would have been willing to have
had the negro acquitted.
