APPLICATION FOR CHARTER
Georgia, Burke county—To the Su
perior court of said county:
The petiiton of J. P. Walea of Eman
uel county, Georgia and H. T. Walea
and E. W. Brooks of Burke county,
Georgia, respectfully shows:
1 That they desire for themselves,
their associates and successors, to be
incorporated and made a body politic
unuer the name and style of Midville
Grocery and Brokerage Company, for
the period of twenty (20) years.
2. The principal office of said com
pany shall be in the city of Midville,
State and county aforesaid, but peti
tioners desire the right to establish
branch offices within this state or else
where. whenever the holders of a ma
jority of the stock may so determine.
3. The object pf said corporation is
pecuniary gain to itself and its share
holders.
4. The business to oe carried by by
said corporation is a wholesale and
retail business, handling groceries,
feed stuff, hradware, dry goods, no
tions, with authority to buy and sell
real estate, horses and mules, auto
mobiles, wagons, buggies and vehicles
of every kind, tractors and form im
plements, and to receive goods on as
signment and handle them for ether
parties on an agency of brokerage
basis.
5. The capital stock of said corpora
tion shall be fifteen thousand ($15,-
000.00) dollars, fully paid in, with
the privilege of increasing same to
the sum of twenty-five tnousand
($25,000.00) dollars by a majority
vote of the stockholders, said stock
to be divided into shares of one hun
dred ($100.00) dollars each.
6. Petitioners desire the right to
sue and be sued, to plead and be im
pleade, to have and use a common
sead, to make all necessary by laws
and regulations, and to do all other
things that may be necessary for the
successful carrying on of said busi
ness, including the right to buy, hold,
and sell real estate and personal
property suitable to the purposes of
the corporation, and to execute notes
,and bonds as evidence of Indebtedness
incurred, which may be incurred, in
the conduct of the affairs of the cor
poration and to sceure the same by
mortgage, security-deed, or other form
of lien under existing laws.
7. They desrie for said incorpora
tion the power and authority to ap
ply for and accept amendments to its
charter of either form or substance
by a vote of a majority of its stock
outstanding at the time. They also
ask authority for said incorporation to
win dup its affairs, liquidate and dsi
continue its business at any time it
may determine to do so by a vote of
two-thirds of its stock outstanding at
the time.
8. They desire for the said incor
poration the right of renewal when
and as provided by the lows of Geor
gia, and that it have all such othre
rights, powers, privileges and immuni
ties as are incident to like incorpora
tions or permissible under the laws of
Georgia.
Whereforefi petitioners pray to be
incorporated under the name and style
aforesaid, with the pouers, privileges
and immunities herein set forth, and
as are now, or may hereofter be allaw
ed a corporation of similar character
under the laws of Georgia.
Petitioners file this their petition in
the office of the Clerk of the Superior
court, nad pray htat after the same
has been advertised as required by
law, that the court by proper order
grant this petition.

deed made by C. S. Inman on the
24th if December, 1921, to the Bank of
Midville, of the county of Burke and
state of Georgia, and by them trans
ferred to the Georgia State Bank, of
Midvilh , which said security deed is
recorded in theoffice of the Clerk of
the Superior Court of Burke county,
in Deed Book 25, Pages 117 and 118;
there will be sold before the court
house door in the city of Waynesboro,
Burke county Georgia, at public out
cry between the legal hours of sale,
on the First Tuesday in March, 1924,
to the highest bidder for cash, the fol
lowing property, to wit:
All of that tract or parcel of land,
situate, lying and being in the 73d.
District, G. M. Burke county, Georgia,
containing two hundred twenty one
(221) acres more or less, bounded on
the north by lands of Hattie Branan,
east by lands of Mrs. Mae Drew,
south by lands of W. D. Drew and on
the west by lands of Mrs. Mae Drew
same being sold subject to a security
deed for $25,000 from C. S. Inman to the
Old Dominion Trust Company, said
deed recorded in deed book 25, page
115 also a certain house and lot sit
uate, lying and being in the town of
Midville, Ga., located on Jones street
and bounded on the north by lot of
R. M. Murphree, east by W. R. Lowe
south by Paul D. Drew and on the
west by Jones street, and having a
frontage of 100 feet on Jones street
and running back equal width 210
feet, the security deed held by Georgia
State Bank over the house and lot
being the first lien.
Said deed was given to secure a
not of C. S. Inman to the Bank of
Midville and by the Bank of Midville
transferred to their successors, the
Georgia State Bank of Midville, Ga.,
said note dated December 24, 1921 and
being due on demand for the princi
pal sum of $3,298.06 with interest from
date, December 24, 1921 at 8 per cent,
per annum, that there has been paid
on the interest on said note $125.00,
Sept 21, 1923, and $50,00 October 13th,
1923 and there is a balance due of
$3,298.06 principal nad $580.82 inter
est and there is due for fire insurance,
which has bene paid by the bank,
$6.00 and for taxes $
The said C. S. Inman having failed
to pay said balance due on said note,
the said Georgia State Bank of Mid
ville, Ga., as successors and trans
feree of the Bank of Midville, Ga., ex
ercises its rights and privileges con
atined in said deed, and offers the
property therein contained for sale,
according to the terms mentioned in
said deed and for the purpose of pay
ing the balance due on said note, the
interest, insurance, taxes and expense
of this proceeding, the proceeds of
said sale to be used, first for the pay
ment of the balance on said note the
principal, interest, taxes and expense
of this proceeding, and the remaind
er if any, to be paid to the said C. S.
Inman or his legal representatives.
The undersigned will make titles
to the purchaser or purchasers, ac
cording to the provisions contained in
said deed, this the 6th day of Feb
ruary, 1924.
