The following official comparison of the two Muscle Shoals bills now pending be
fore Congress is submitted to the people of Georgia that they may de
termine at a glance which of these two bills offers more to the
Government and the people.
HULL BILL
(Based on Proposal of Power Companies of South)
1. $15,000,000 of capital (one company). Owned
by Americans.
2. United States deeds to company:
Nothing. ,

3. United States leases for 50 years nitrate plant
No. 1 and power plants under Federal water power
act.
4. Agrees to make 50,(100 tons annually of fixed
nitrogen.
To furnish 100,000 horsepower for fertilizer at
cost, and 40,000 additional as required.
To maintain nitrate plant No. 2 at present nitro
gen capacity of 40,000 tons.
In case of war 90,000 tons of nitrogen available.
5. Forfeiture of lease on nitrate plant and water
plants if agreement violated.
Government may take over in case of war; does
not require Government to protect company against
losses.
6. Government has right to recapture all property
leased at end of 50 years.
7. Federal water act provides that no value shall he
allowed for power leases in cases of recapture.
8. Regulation by public authority as to rates, ser.
vice, and security issues.
Profits limited by public authority.
9. Power in excess of that used in fertilizer avail
able throughout Southeastern States.
10. Offers cash payment of $4,500,000 for 90,000-
horsepower steam plant at Muscle Shoals if Gov
ernment desires to sell.
Government retains title to balance of properties.
Devotes at least $1,000,000 for research work.
11. Agrees to pay toward headwater improve
ments as required by Federal water power a,ct.
12. Rental Dams Nos. 2 and 3 for 60 years, $138,-
080,400; total for 100 years, $295,629,400.
Savings to Government for 50 years, $34,218,000.

New 40,000 horsepower steam plant and
transmission lines to be erected by

3. In addition to deeding above properties, United
States also leases for 100 years the water plants,
disregarding Federal water power act.
4. Agrees to make 40,000 tons annually of fixed
nitrogen.
No promise as to amount or cost of power.
To maintain nitrate plant No. 2, or its equivalent
(estimated by Ordinance Department to cost not
over SIOO,OOO per annum, or $10,000,000 in 100 years).
In case of war, 40,000 tons of nitrogen available.
5. No forfeiture of nitrate plants, steam plants, or
quarry for violation of agreement; forfeiture un
der certain condition of waterpower lease. Govern
ment loses control and ownership of both nitrate
plans, steam plants, and quarry, except may take
over plant No. 2 in case of war on “protecting com
pany from losses occasioned by such use, and shall
return the said property in as good condition as when
received and reasonable compensate company for
the use thereof.”
6. No right of recapture as to nitrate plans, steam
plant, and quarry.
Ford has preferred right to renew waterpower
leases at end of 100 years.
7. In absence of express stipulation, courts would
be required to value power leases in proceeding to
take over power plants by Government if that should
ever be desirable.
8. No regulation of rates, service, or security issues
Profits not regulated except as to fertilizer.
9. Power available only to Ford plants at Muscle
Shoals.
10. Offers $1,627,512.75 for both nitrate plants,
steam plants and quarry costing Government over
$80,000,000, and divests Government of title to same
11. Pays nothing for headwater improvements.
12. Rental Dams Nos. 2 and 3 for 60 years, $103,-
855,564; total for 100 years, $219,964,954.
