All that lot or parcel of land with im
provements thereon situate and being in
the McBean Road Subdivision (now
sometimes called Rosemont Heights) in
the City of Waynesboro, Burke County,
Georgia, and being particularly shown
and designated as Lot ten (10), Block
G, upon a certain plat of survey made
by J.C. Wells, Surveyor, dated May 17,
1951, recorded in the Office of the Clerk
of Burke Superior Court in Plat Book 3,
Page 48, reference being made to said
plat for a more complete and accurate
description of said lot, its exact location,
dimensins, metes and bounds. The im
provements on said lot are known under
the present system of house numbering
of Waynesboro, Georgia, as 730-732
Savannah Avenue, Jerry R. Baker was
conveyed the contract purchase rights
in this property by deed of Eunice P.
Quick et al., dated June 7, 1985, re
corded in said Clerk’s Office in Deed
Book 146, Pages 522-523.
The debt secured by said Security
Deed has been and is hereby declared
due because of, among other possible
events of default, failure to pay the in
debtedness as and when due and in the
manner provided in the Note and Se
curity Deed.
The debt remaining in default, this sale
will be made for the purpose of paying
the same and all expenses of this sale,
as provided in Security Deed and by
law, including attorney/Es fees (notice
of intent to collect attorney’s fees having
been given).
Said property will be sold subject to any
outstanding ad valorem taxes (including
taxes which are a lien, but not yet due
and payable), any matters which might
be disclosed by an accurate survey and
inspection of the property, any assess
ments, liens, encumbrances, zoning or
dinances, restrictions, covenants, and
matters of record superior to the Secur
ity Deed first set out above.
The entity that has full authority to ne
gotiate, amend, and modify all terms of
the mortgage with the debtor is: Wa

way Trail will be received by the CITY

This project is being funded in part by
the Georgia Department of Transporta

The Work will be substantially complet
ed within 150 days from the date when
the Contract Time commences to run as
provided in paragraph 2.3 of the Gen
eral Conditions, and completed and
ready for final payment in accordance
with paragraph 14.13 of the General
Conditions within 180 days from the
date when the Contract Time com
mences to run.
CONTRACTOR shall submit Applica
tions for Payment in accordance with
Article 14 of the General Conditions.
Applications for Payment will be pro
cessed by ENGINEER as provided in
the General Conditions. OWNER shall
make progress payments on account of
the Contract Price on the basis of CON
TRACTOR’S Applications for Payment
as recommended by ENGINEER, on a
date to be determined at the Pre Con
struction Conference. All progress pay
ments will be on the basis of the
progress of the Work measured by the
schedule of values established in para
graph 2.9 of the General Conditions
(and in case of Unit Price Work based
on the number of units completed) or, in
the event there is no schedule of val
ues, as provided in the General Re
quirements. Prior to Substantial Com
pletion, progress payments will be made
in an amount equal to the percentage
indicated below, but, in each case, less
the aggregate of payments previously
made and less such amounts as ENGI
NEER shall determine, or OWNER may
withhold, in accordance with paragraph
14.7 of the General Conditions - 90% of
Work completed. If Work has been 50%
completed as determined by ENGI
NEER, and if the character and
progress of the Work have been satis
factory to OWNER and ENGINEER,
OWNER on recommendation of ENGI
NEER, may determine that as long as
the character and progress of the Work
remain satisfactory to them, there will
be no additional retainage on account of
Work completed in which case the re
maining progress payments prior to
Substantial Completion will be in an
amount equal to 100% of the Work
completed. 90% of materials and equip
ment not incorporated in the Work (but
delivered, suitably stored and accom
panied by documentation satisfactory to
OWNER as provided in paragraph 14.2
of the General Conditions). Final pay
ment of amounts withheld or deposited
in escrow need not be made until the is
suance of the chief engineer’s certifica
tion of satisfactory completion of work
and acceptance thereof, as provided in
Code Sections 32-2-75 through 32-2-77.
The OWNER reserves the right to reject
any and all bids if it appears in his best
interest to do so.
