The debt secured by said Deed to Secure
Debt has been and is hereby declared due
because of, among other possible events of
default, failure to pay the indebtedness as and
when due and in the manner provided in the
Note and Deed to Secure Debt. Because the
debt remains in default, this sale will be made
for the purpose of paying the same and all
expenses of this sale, as provided in the Deed
to Secure Debt and by law, including attorney’s
fees (notice of intent to collect attorney’s fees
having been given): The entity that has full
authority to negotiate, amend, and modify all
terms of the mortgage with the debtor is:

yet due and payable), (b) any matters which

inspection of the property, and (c) all matters
of record superior to the Deed to Secure Debt

By virtue of a Power of Sale contained in
that certain Deed to Secure Debt from Lloyd
T. Hudson, Sr. to Popular Housing Services,
Inc, dated August 25, 2006 and recorded in
Deed Book 615, Page 24, in the Office of the
Clerk of Superior Court of Burke County
Georgia, said Deed to Secure Debt having
been given to secure a Note, dated August 25,
2006, in the original principal amount of Eighty
Six Thousand Five Hundred Eighty Seven and
26/100 Dollars ($86,587.26) with interest
thereon as provided therein, having been last
sold, assigned and transferred to 21st
Mortgage Corporation, recorded in Deed
Book 731, Page 205, aforesaid records, will
be sold at public outcry to the highest bidder
for cash before the courthouse door of Burke
County, Georgia, within the legal hours of sale
on the first Tuesday of October 2010 regarding
the following described property:
All that tract or parcel of land, situate, lying
and being in the 68th G.M.D, Burke County,
Georgia and more particularly shown and
described as Tract 1, containing 1.35 acres,
more or less, upon a plat of survey entitled
“Division of Property for William R. Hales and
Ruth Watts,” prepared by Steve Bargeron and
Associates, Steve Bargeron (GA Reg No.
1871), dated April 11,2002. Said plat of survey
was recorded in the Office of the Clerk of
Superior Court of Burke County, Georgia in
Plat File No. A-8967 on May 20, 2002. Said
plat of survey is by reference incorporated
herein and made a part hereof.
This being the same property as that
conveyed by deed recorded in Deed Book 611,
at Pages 13-14 of said records.
Also conveyed herewith is a 2006 New
Century Homes 28x80 Cavalier Model

number BL06GA0213910AB, which is
permanently attached to and made a part of
the real property.

The indebtedness secured by said Deed to
Secure Debt has been and is hereby declared
due because of default under the terms of said
Deed to Secure Debt and Note, including but
not limited to the nonpayment of the
indebtedness as and when due. The
indebtedness remaining in default, this sale
will be made for the purpose of paying the
same, all expenses of the sale, including
attorney’s fees and all other payments provided
for under the terms of the Deed to Secure Debt
and Note.
Said property will be sold subject to the
following items which may effect the title of said
property; zoning ordinances, matters which
would be disclosed by an accurate survey or
by an inspection of the property; any
outstanding taxes, including but not limited to
ad valorem taxes, which constitute liens upon
said property; special assessments; all
outstanding bills for public utilities which
constitute liens upon said property; all
restrictive covenants, easements, rights-of-
way and any other matters of record superior
to said Deed to Secure Debt. To the best of the
