Ga. Supreme Court still
looking at judicial split
Chief Justice David Nahmias
will soon render a decision on
the constitutionality of Georgia
Senate Bill 9, which authorized
the Augusta Judicial Split.
Nahmias heard the combined
arguments from live pending
petitions November 9. The
lawsuits contend the split is a
violation of the Voting Rights
Act of 1965.
Senior Assistant Attorney
General Russ Willard pointed
out that Article 6 of the Georgia
Constitution grants authority to
the General Assembly to cre
ate, abolish or modify judicial
circuits.
“No votes were nullified
through SB9. no impediment to
the right to vote through voting
qualihcation or practice was
created by Senate Bill 9. Nor
have the appellants shown any
discriminatory effect on voters
through the enactment of Sen
ate Bill 9” he said.
Chief Deputy Lee Webster approached the BOC November
9 with a complaint about office space at the Cotton Ware
houses.

The Board of Commission
ers voted unanimously No
vember 9 to adopt a resolution
similar to the one adopted by
Butts County that ends local
supplements at the end of the
current occupant’s term of of
fice. The cuts are limited to lo
cal elected officials excluding
Superior Court judges. Specifi
cally mentioned in the resolu
tion are the Clerk of Courts, the
Sheriff, Magistrate Judge and
the Tax Commissioner.
During the same meeting,
the panel decided to hold on
to their objection for the city’s
proposed annexation of the
site on Brinson Road while the
council hashes out the details of
the project. Developer Repre
sentative Mike Smith reiterated
to the board that the proposed
construction includes 1,700 to
2,000 square foot townhomes
and not apartments.
The BOC also listened
to Chief Deputy Lee Web
ster’s complaint regarding
approved renovations of the
Cotton Warehouses. The Burke
County Sheriff’s Office utilizes
part of one of the warehouses
for administrative purposes.
Webster said renovation plans
do not include specific space
for the Sheriff’s Office. The de
partment has asked numerous
times for advisement, he said.
“I’ve seen the plan and it
shows that the space is no lon
ger there,” Webster said.
The panel elected to move
forward with the renovations.
The panel advised Webster
that they will work with the
BCSO to figure out how the
department can continue to be
accommodated in one of the
warehouses by utilizing their
own budget funds.
“We don’t tell the Sheriff
how to spend his money,”
County Manager Merv Wal
drop said.
