The chairs of Aldermen Van, Harris
and Dinkier were vacant last night'
at the meeting of council, and conse
quently Aldermen Collins, Hurley, AU-
{.j mayer, Klley, Howes, Sporry, Hill,
Findlay and Chairman Carling wore
the burden bearers. ,
The proceeding! of th'e previous meet
ing were ndopteu and disposed of and
then came a number! of petition^
among which was one from Gabourj"
& Noble, the sewer contractors, to have
the ordinance regulating sewer pipe
connections deferred until the work of
laying the sewers had been been ap
proved, as It interfered with tho work.
The petition went to the board of pub
lic works, the sewer committee and
tho advisory committee.
City Engineer W'iloox presented a
petition to run the roadtvgy in the oeh-
tre of Third street between Walnut
and Mulberry, instead of on tho s.des,
as is now the ease. Referred to com
mittee on streets.
Following this Chairman Carling
read a number of bills that were passed
In open council.
' On the call for reports of committees,
the ordinance committee reported an
ordinance on sidewalks that requires
all persons putting down sidewalks in
the Are limits to use stone, eement or
vitrified brick hereafter. At the proper
time this ordinance was' put on Its sec
ond reading and passed.
■The light committee reported that, in
their opinion. It was best to bold in
abeyance for tho present the matter
of letting out' the contract for lighting
the city, and the report was adopted.
IJie special committee appointed-''
Investigate the cutting down of trees
in Ayres’ Park and to locate Hie blame,
made a report in substance as follows:
“Wo, your committee appointed to In.
vestlgate the Cutting down of trees in
Ayres’ Park and to ascertain who Is
to blame for so doing, find that no
blame Is attached to the public works
commission, as tho work was done at
regular hours and not Dofore, as re
ported, and thut the blame rests with
the properly owners In the neighbor
hood, who failed to petition council to
let the trees remain.” The report was
unanimously adopted.
A communication from the mayor
recommending the further grading «f
Walnut street so as to carry out tho
work already started and saying that
it would co'st about $21000 or S2.MOO,
was referred to the street committee,
Another communication from tho
mnynr asking for authority to sign
deeds to property owners on Second
street who had been grouted encroach
ments, and, on motion, the authority
wns given.
Mayor Horne, as chairman of the
committee on legislation, submitted tho
following resolution, accompanied by
the amendments to the charter, all of
which were adopted: •

"To .repeat section 3. and the substi
tution therefor of th fiollowlnfi:
•"That the city of Maoon be divided
Into four wards, numbered respectively
one. two. three and four. The first
ward shall be Included tn the following
boundaries: All of East, Macon, and
that if nation of West Macon lying be
tween the Oomulgee river and the east
side of Plum street, and between the
lower or southern nine of •jl**t street
and the southeastern ttmtta. The second
ward is included between theweatsMe
of Plum street and the oast rtae of
Boundary street, and between the lower
or southern- side of First street nndthe
couth-western limits. The third ward Is
Included between the upper br northern
side of Find; street and the northeast
ern limits, and between the Ocmulgee
river and r. line made by the eastern
side of Plum and High streets and
Washington avenue. The fourth ward
Is lurtuded between the upper or north,

ride of Boundary street and a line made
by the west ride of Plum end High
streets and Washington avenue.
"To repeal section 4. and the substi
tution therefor of the following:
"That on the second Wedncnlay In
December. 1894. there shall be an elec
tion for six • aldermen, one from each
ward end two from the city at large,
the former for a term of three years:
and the latter for « term of one year;
anl on the second Wednesday in Decem
ber. IMS. there shall be an election for
mayor and elgWt aldermen, or two al
dermen from eaeh ward, four of whom
shell serve for a term of three years
and fostr for a term of one year, end on
the seooal Wednesday iu December an
nually thereafter there shall be an elec
tion for four aldermen, one for each
ward, or for mayor and four aldehmca.

"That the term of oOlce of mayor
shall be three years and until his suc

receive a salary of not less than two
thousand dollars per annum. He shall
be the chief executive officer of the
city, and shall have general supervision
over all Its departments, servants and
affaire, sign sH deeds end contracts, ap
prove all bills end vouchees for the pay
ment of money, and shall be ex-olfirto a
member of all oommltteee, of the board
Of public works, police commission ard
fire commission and board of health. It
•ball be tile duty to see that ell laws
end ordnances of the city are faithfully
executed. He ehaH keep the ooutscll ad
vised from time to time of the general
condition of the city, and Shall recom
mend such meavires as he may deem
nereeeiry or expedient for the welfare

provement of all public work. Including
sewerage, parking, paving, und other
Improvements of streets; they shall
have .power to advertise for bids for
.such work, make contracts for same,
said contraoin being In all cases subject
to approval by the mayor and council.
The mayor and counoll may maintain a
force of hands for the purpose of mak
ing necessary repairs on the streets,
said fores of hands to be under the con
trol of said mayor and council.
Amend seoUao 51 by adding to the
duties of the marshal: He «iall also
be ex-olfido an assessor, and shall,
from ills best information possible, ob
tain during each year the amount of
loath real and personal property owned
or held by all persona residing or own
ing or holding property tn the city of
Macon which la subject to taxation,

Repeal section 80 and, substitute
therefor the following:

Amend the act authorising the city
bf Macon to issue bonds in the sum of
two hundred thousand dollars for the
purpose of building a system of sani
tary sewers so as to provide for the
drainage of the city reserve, the build
ing of dnalnagp newel's, eke., and to
rotund a port of said Issue of bonds
as follows:
On the completion ot the present
sewer work, and after the amount of
money required lor such work has Been
ascertained, to empower the .mayor
and council to refund or exchange said
amount of bonds In 41-2 per cent;
bonds, the maturity of the same to be
gin sixteen yeans from dato of Issue,
and' One-fifteenth Of the issue to ma
ture annually thereafter.
' Wfit ithq mayor and council are
{tereby authorized to devote so much
of the proceeds otf the sale of said
bonds remaining over after th« said
sewers are built and paid for as may
be necessary for the drainage of the
southern, southeastern trad southwest
ern, reservo of said city ot Macon.
That said drainage of said reserve
shat! be done under the supervision
of the said mayor and ooundl and
the engineer of ajld city; provided,
however, that should the board of
commissioner! of Bibb county decide to
cooperate with said mayor and coun
cil In said work, of drainage of the re
serve, and bear a portion of the ex
pense thereof, then the mayor am*
oouncl are hereby authorized to co-
operoUe and share said- expense.
That any surplus remaining over af
ter the construction of the said sew
ers and said drainage of Ole rese/ve
shall be devoted to the construction of
drainage sewers dr any other puuTTc
Improvement that may be authorized
by ordinance of the mayor and coun

, Amend the act creating the board
commission by granting further pow
ers, to-wit: To allow said commission
to purchase city of Macon bonds on
the basis of 41-2 per cent from date
of purchase to maturity. All auch
bonds as may be purchased to be can
celed; to empower the said commis
sion to refund or exchange the present
Issue of bonds m bonds bearing 41-2
per cent. Interest end running thirty
years from ante of Issue, provided the
same can be done without payment of
any premium, therefor.
To amend the charter of the city of
Macon by a separate act go as to au
thorize the Issue of bonds for tbe Im
provement of streets, etc., os follows;
To authorize the Issuo of bonds to
thcamount of 3150,000 in denominations
of not less than 8500, as the mayopCnd
council may determine; to bear Inter
est at the rote of 41-2 per cent, per
annum, payable quarterly, and to fall
due as follows: 310,000 la 16 years from
dbte of Issue, and 310,000 annually
thereafter until the entire issue slwi'
have been-paid. The proceeds of said
bonds to be used exclusively for per
manent Improvement* as follows: TEe
total Issue'of 3150,000 shell be used for
Paving, nwcadamlzlng, grading, or
curbing, either In whole or such pro
rata share of the expense thereof c

curbing or other Improvements that

on each side of the street on which the
sidewalk Is so- improved as may be
prescribed by ordinance of the mayor
and council; provided, that the ownen
of said abutting read estate shall be
given fifteen days’ notice to make
such improvement! and shall fall to
do so.
That the mayor and council shall
have full power and authority to as
sess the cost of grading, paving, ma
cadamising and otherwise Improving
the roadway or street proper on the
real estate abutting on each aide of
tho street so Improved as may be pre
scribed by ordinance! provided that be
fore any street or portion of a street
shall be so Improved the person or
persons owning said real eaute, which
constitutes at least a majority or ibe
frontage on the street or portion of
a stree'i. the Improvement of which It
desired, shall In writing request the
mayor aad council, who shall refer toe
same to the board of public work*, and
after aald board of public works shall
have approved the same aud shall for-
ward toe same to the mayor and coun
cil with their approval, with a ehUe-
raent of the character of the Improve
ments proposed to be made and an es
timate of the cost of tbe tame, and
said mayor and council shall then, If
they see fit, by an ordinance, direct
the said work to be done; and provided
further, that any street railroad com
pany hxvTfcg tracks running through
the stream so' paved or macadamized
or otherwise Improved, shall he re
quired to pay for the said Improve
ment ns toe contracts existing between
said street railway companies and the
city require to be done by the mayor
und council and as they may direct’;
and sSouSd said street railway compa
nies refuse or fall to do so after fifteen
days’ notice, then the expense of eamo
shall be assessed against said street
railway companies.
That It shall be wholly discretionary
with the mayor and council whether
tray work asked for Is desirable or
necessary' and. shall be done or not;
and do’application shall be received
and no work done for less than an
dative block; provided, that the ma
jority of the frontage on a block shall
not, by a failure to apply for work or
by objections thereto have power to
defeat an application of the owners
of a majority of tha frontage of more
than a block, when such application
shill Kive Been regularly made.
That the amount of assee»ment on
each piece, of real estate as above pro
vided shall be a first Hen on said real es
tates from toe day of the passage of
toe ordinance providing for the work.
That the mayor and council shall
have authority to enforce the collection
of the amount of any assessment regu
larly made for work, either upon streets
or sidewalks, by executions to be Is
sued by toe city treasurer against the
real estate so assessed and against toe
owner thereof! at the expiration of thir
ty days from the completion of work,
which execution shall be levied by the
etty marshal on such real estate, end
after advertisement and other proceed
ings as in cases of sales for city taxes,
the same m.ty be sold at public outcry
to The highest bidder, and such sale
shall vest an nbsolute title In the pur-
chaser; provided, that -he defendant
shell have the right to file an affidavit
denying that toe whole, or any part tf
tho amount for which the execution la-
sued Is due. and stating what amount
he admits to be due. which amount ad
mitted to be duo shall be paid nr col
lected and the affidavit received for the
balance; all such affidavits so received
shall be returned to the superior court
of Bibb county and there tried, and the
Issue determined as In cases of lllegail-

delay.
That all executions Issued by too city
for assessments for permanent Improve
ments of streets or sidewalks or other
wise. shall bear Interest at the rate of
6 per oent. per'annum from the time
fixed by the preceding teotlon.
On motion of Alderman Collins toe
committee on legislation was Instructed
to go to Atlanta es toon n« possible and
urge upon the representatives of Bibb
county tn toe legislature toe passage of
all or cs many of the aroendemtns os
they see fit The city attorney was also
added to toe commtttee.
Another communication from the may-'
or recommended the drain-age of tho
swamp according to plans nnd specifi
cations made by Engineer Powers, and
providing for paying toe cxptnsm of
the same. On motion of Alderman Find
ley. toe communication was held ewer
until tho legislature had toted on the
amendments to too charter, as provis
ion Is made for draining the swamp In
the amendments.
Alderman Sperry Introduced an ordi
nance regulating the manner of making
tax returns and the payment of tuxes,
which was put on Its second reading
and passed.
Alderman Altmayer Introduced an or
dinance providing for a board of .plumb
ing examiners, that was put on Its first
reading. . •
An unsigned ordinance regulating
s»wc-r connections and providing for
prescribing penalties for violation* was
Put on Its second reading and adopted.
