Southern cotton .mill representatives
are at present In this city holding con-
/©rentes over the organisation of the
Southern Textile Company, which was
recently organised under the laws of
New Jersey.

Jndjic Speer Holds that Widow I*
Entitled to Insurance Money on
an Equity in It.
judge Emory Speer held yesterday
that Mrs. Ro«a Josephson vraa entttled
to J6 000U Insurance left by her late hus
band, Simon Joiephson. The husband
went Into bankruptcy and at the time
had life insurance policies to the
amount of 16,000.
The trustee who took charge of the
Josephfion estate did not Include these
pojtles In the assets, alleging that the
bankrupt had told him they had lapsed
,,n account of his failure to keep up the
premiums. The in«urance companies
filed an Interpleader and asked the
court to direct them to whom the
money should be paid. The matter was

referred to the referee.
Referee Proudflt held that thla insur
ance money belonged to the creditors,
but inasmuch as Mr. Josephson had
paid two of the premiums, he allowed
the amount she paid and 20 per cent,
of the principal Sum, |6.000i as interest.
The case was appealed,and Judge Speer
overruled the referee, giving the widow
the entire amount. The following, In
part, Is Judge Speer’s decision:
“If the creditors will now undertake
<Xh ^ to show that there is a cash surrender
lw value, the court will permit them to do
no, and if they succeed In this, will re
quire the cash surrender value to be
paid out of the proceeds of the policy,
otherwise, in the opinion of the court,
the whole proceeds must be paid to
Mrs. Josephson, as executrix. Upon the
hearing before the referee, ^he trustees
were permitted to testify that Joseph-
Bon. when In life, had told them that
the policies had lapsed and were there
fore valueless, and that on account of
this assurance they were surrendered
to him. The competency of the wit
nesses were objected to by counsel for
Mrs. Josephson. It clearly seems that
the test of competency of witnesses be
fore a court of bankruptcy is the test
afforded by the state law, and It is 1
equully clear that under the statutes of
Georgia, the trustees In this case could
not be heard In their suit against his
widow to give their personal recollec
tion of transactions or occurrences with
the bankrupt. No matter what the trus
tees recall after a lapse of fifteen
months and the death of Josephson,that
he had said on this subject, the policies
would have been no more valuable to
the estate, unless indeed Josephson had
