Council met at 8 o'clock last night,
under the rule adopted at the previous
meeting. .All the local statesmen
seemed to be In good humor. Each had
partaken of a good dinner, and there
is nothing that smooths the acerbities
of life like a good dinner. A .full stom

A communication was received from
Mr. Frank Gunn, asking that he b«
given a hearing on the assessment of
certain property. The request was
granted.
A communication was received from
E. J. Willingham. John Shlnholser and
J. B. niley. special committee from
the Macon Fair Association, asking nu
appropriation of $5,000 to put tin
grounds and buildings In condition foi
the State Fair and to provide police set'
vice at the fair. The communication.

Brothers, asking for a hearing In
erence to cloning a certain alley,
quest for a bearing granted.
A request from Henry Stevens
read. He asked that a line Impose

certain encroachment granted by

mdltlons of the grant having been
implied with.
Alderman Jones aaked If Mr. Artope
nd laid A cement sidewalk, which was
ne of the conditions of the grant.
It developed that the sidewalk had
ot been laid.
Alderman Jones Insisted that the con-
Itlon be complied with before a deed

Mayor Smith Mid he would not sign
Alderman Damour called attention
th# statement "that nil the conditions
had been complied with," "and
appears, M he said, "thnt such Is
case."
Alderman Redmond stated thnt the
sidewalk could not be laid until the
building was completed.
The subject was passed, with the un
derstanding that Mayor Smith would
hold up the deed till every condition
was compiled with.
Aldarman Jones, from committee on
streets, presented n request from the
city engineer for authority to remove a
fence on Fifth street that encroached
upon the street and impeded street itn-
provement work. The request was re
ferred to the encroachment commit
tee.
A report from Alderman Jones, ns
chairman of the street committee, rela
tive to certain Improvements on Geor
gia avenue, elicited Information from
the mayor that nn Injunction had been
a%rved upon him nnd the city engineer
enjoining the mayor and council from
proceeding With the work.
After some discussion ns to the pro
priety of taking nny further action,
pending the determination of the in
junction proceedings, the subject was
referred to the committee on streets.
Alderman Williams, from the com
mittee on police, reported thnt the com-
ild«not recommend any change

port was agreed to.
When the report of the sexton was
submitted by Alderman Chostney. a
brief colloquy took place between him
Alderman Jones. The latter want

when there are no lots to sell, what
will you. do? Where will the profit
come from?"
The questions were not answered.
A communication was received from
Mr. H. U. Westcott tendering hla resig
nation as market muster.
Alderman Jones moved thnt the
mayor and council accept the resigna
tion with regret.
Alderman llupp said he thought
something more war required In the
premises, and suggested thnt a com
mittee be named to draft suitable res
olutions expressing the appreciation of
the mayor and council of Mr. Worri
t's long and meritorious service ns

Alderman Jones nominated Mr. Loo
Wages for market master.
Alderman Redmond moved that the

Alderman Jones moved ns a substi
tute that council proceed to the* elec
tion of Lee Wages at a salary of $63
per month, which would effect n rav
ing of $30 per month, as the city had
been paying two men $95 per month,
and Mr. Wages had performed all th*»
work.
Abb-rnmn Hnpp seconded the motion
of Alderman Jones.
The vote being taken on the substi
tute. it was adopted.
A vote was then taken on the motion
to elect Mr. Leo Wages, at a salary of
$63 per month, and tho motion pre
vailed.
The city attorney reported to coun
cil that Mr. John Shlnholser, repre
senting Mrs. Alice Shlnholser,' had de
cided to disregard action of council ns
to the line of the Curd lot along the
alley between Cherry and Mulberry
streets, recently established by tho
granting of nn encroachment of two
and a half feet, upon which a brick
wall Is now In process of erection, and
declined to pay tho $50 required for
said encroachment, as he thought It
should be paid by the former owners.
The city attorney asked direction from
< ouncll in the premises.
Alderman Jones said he thought the
city ought to stop the work; that* while
he voted for this encroachment, he
opposed to granting encroachments
upon alloys, lie moved that the
take action at once tp compel the
mnvnl of the wall.
Alderman llapp thought council had
gone too far to make such a course
permissible. "The encroachment
been granted," he said, "and the only
course open to the city, it seems to
