comfort her. Mrs. Chadwick’s face waa
Inflamed and she bad all tho appear
ance of a woman suffering greatly from
nervou.neee.
Mrs. Chadwick's aon Emil was asked
If he had eeen the statement made by
Mrs. York of Ban Francisco, relative to
his mother's past llfa. He aald he bad.
Will you ask your mother if she will

Emil went to hla mother, talked to
her In a low tone for a few seconds and
then came back and aald hla mother

Dying on the couch, and Interrupted
at Intervals by alight nervous tremors,
Mrs. Chsdwlck said In reference to
Mrs. York's statement:

"No. she Is neither my sister nor my

"I have made absolutely no state

Justice to my little boy 1 would not
do It at the present time. I don't think
that any responsible person would pay

Mr. Chadwick, it Is Intimated In
some of the afternoon papers that thla
young woman you have here with you
not your maid but a relative of
yours, possibly your daughter.
The young woman was sitting beside

1 am her nurse. I am a graduate from
the Nurse's Institution In Stockholm,

bank failure, saying It would not have

ed, as usual, after the commencement
of the New Year to extend the usual
accommodation to the planting com
munity upon well-secured paper.
As the Exchange Bank Is now car
rying about 1600,000 of cotton in Ma
con It stands ready to carry $600,000
more.
The prosperity of the Exchange
Bank for over a third of a century h is

INJUNCTION WAS
City Attorney Mlnter Wimberly ap
pealed the Jemlson cas* yesterday from
the federal court of Macon to.the United
States supreme court, nnd the caso will
now be heard by tho highest tribunal
In tho land. The city attorney makes
the charge that tho decree of the federal
court In Macon waa erroneous because It
had no Jurisdiction. All the claims of
error uro 1 List'd upon this and here tho
fight will )>e made when there la oppor
tunity in tho supreme court.
Tho city attorney has been busy with
this cuse for a long tlmo. and despite tho
fact that there has been other heavy
business on hand, he has prepared for the
fight. It Is not known at what time
the case will be heard In the supreme
court, but It can tie said that thla will
not take place within two or three
months.
Ing the case, and was without Jurisdiction
because the negro hud not applied at the
other Intervening courts of Justice stand
ing between the recorder's court and the
federal court. He also charges that the
hearing before Judge Spoer was erroneous
bocause the averment In tho petition de
claring that Jemlson was tried and con
victed without Indictment, accusation or
written charge did not raise a federal
question.
There are other reasons given why the
fedcrol court erred. tho principal of which
Is that the recorder’s court Is a court of
competent Jurisdiction nnd empowered by
tho state lows to try and sentence offend
ers upon charges similar to those against
Jemlson.

decision In the patent case of Cnurh
Brea, and J. J. Fagan Company against
J. O. Barnett of Amerleus, whlrti
railed far the dissolution of the In
junction against Barnett, and the raae
will now go Into the court oa a bill
In equity and will be tried on its
merits. A temporary bill of Injunction
had been granted some time ago which
restrained Barnett from further mak
ing o certain horse collar, and the
hearing woo sat for the present week.
The case has occupied more than two
days In the federal court and strong
legal work has been done by members
of the local bar on tha case aa welt
aa by members of the Atlanta bar and
the Amerleue bar.
The decision of yesterday allows
both parties to ga forward with- their
business until there la a further hear
ing upon a suit In equity which will
be pushed by the Arm In Atlanta .This
Arm failed to secure a permaent In
junction at the trial set for the pres
ent week and must light the case fur
ther upon Its merits.
