foreign account. In spite of the easier
tone of the London discount market,
based on the failure to advance the off I-
dal discount rate of the Bank of Eng
land. Incoming reports of railroad net
earnings for October Indicate that the
September rate for Improvement was. not
fully maintained at that time, either In
the gross or rih© net. the decrease In
gross being larger and the increase In
net by curtailment of operating expenses
smaller than In the earlier comparison.
Latest returns of gross earnings for No
vember also show no growth In the rati
of the Increase over earlier periods. The
early movement to market of both grain
and cotton la supposed to be responsible
In part for the slowing dowp In the rate
of Improvement

IN FEDERAL COURT
CHARGE AGAINST J. J. FLAHIVE
NOT 8U8TAINED AND JUDGE
SPEER GRANTS WRIT OF
DISCHARGE.
The bearing of the objection* of
creditor* of the defendant to the dla-
charge In bankruptcy of J. J. Kla-
hlve. and to the allowance of a home-
etead exemption, occupied the atten
tion of the United State* court yes
terday for the greater part of the day.
Th* case Is legally entitled, "The Ex
ceptions to the Flndlnga of the Ref
eree In the Matter of Exemption of
Bankruptcy In the Cnae of J. J. Fla-
hlve."
Tho defendant'* homo and atorowero
destroyed by a recent Ore. and among
other things, a tin box containing
$2,600 woe aald to have perished In
the Uamei. The burned and battered
box was produced aa evidence In court
and both Mr. and Mr*. Flahlve swore
that Its contents were wholly destroy-
od by the tire. The creditors' objec
Mon was that this money had beci
concealed from thefn and from the
court, and alleging Its possession by
the defendant the allowance of a liomo-
steud objection was-opposed. Objec
tion was uIho niado to a discharge
being granted to Flahlve. There wan
no testimony to show that tho money
contained In the box was not destroy
ed. or that the box produced was not
the one In duestlon. and the court
therefore upheld the defendant, and
directed that Flahlve be granted I
writ of discharge.
