20 —Lome Merrill, tbe female hunter of
this section, has ju->t had another adven
ture worthy of record and one which
came so near costing her life that she will
probably in the future never resume her
masculine sport. A few days ago, just
after the gieat sleet storm which swept
over tbe country, Lottie determined to go
deer hunting. Donning her snow shoes
she started to cross Drig Swamp, a dense
mass ot scrub oaks and laurel. When she
had reached the centre of tbo marsh she
discoveied the foot prints of a very large
bear ou the crust. She followed the trail
out of the swamp for about two miles,
when she discovered the den which the
animal inhabited. Entering the cave
she found two little cubs ou a bed of
leaves in one corner. The cubs were
about the size of kittens and were easily

when sho was met by an immense slie-
bear. The bear had heard the cubs yell
and was making all possible speed to res
cue them. Before Lottie could draw her
rifle to her shoulder the animal was upon
her and grasping her in her paws gave her
such a terrible squeeze that she fainted,
when the bear, thinking her dead, released
her grip. She fortunately recaiued con
sciousness quickly, and while the old
bear was playing with her cubs the plucky
hunter drew her .rifle- end shot her iu the
Bide. The bullet did not strike the ani
mal’s heart, and as the brute dashed at
her again Louie drew her hunting kuife
and with one bold stroke nearly severed
the bear’s head from the body.
Lottie was just congratulating herself
on her successful escape when the dead
bear’s mate made his appearance. Lottie's
rifle was unloaded and she was totally un-
prepaieii for a secoud encounter, hut de
termined to “fight it out.” The struggle
was a long one. Fortunately the voting
lady was not encumbered in her motions
by petticoats, for in all her hunting expe-
dilioiis slits wears pantaloons of doeskin,
with a long blouse. When, finally. Lottie
thouiht the hear was dead she stooped
over to cut his throat, and the animal,
With one stroke of his monstrous paw,tore
the clothing almost completely from her
body. During the protracted struggle tbe
bear hadreachcd the edge of a clifl lully a
hundred feet high and sloping at an angle
of more than forty-five degrees down to the
Wallinpaupack creek. As the animal
grabbed Lottie he commenced sliding on
the slippery cruit down this almost per
pendicular slope. Louie was carried with
him, and every foot of distance traversed
added to their velocity. When they
reached the foot of the slope they struck
against a tree, completely killing the bear
and breakiug two of Lottie's ribs, her left
anu amt one of her limbs. She managed,
hone er, to crawl about a mile to a house,
wleic she received medical treatment.
The first bear killed weighed when dressed
403 pounds and the male one 4S4 pounds.
Lottie, who is improving slowly, has the
cubs in her possession, but she says it will
be sometime before she will take another
expedition at this kind.

President Noah Porter says that he met
George Eliot iu London in 1B53, when

with plain but interesting features, of a
little above medium size, of a very quiet
and almost timid bearing, most noticeable

her last home has for centuries

pure or wholly coasecrated, but still a
temple, of which Christ has been the
light. Early in life, we are told,she knelt
at the shrine of this temple with earnest
worship. Later she turned her back on
this altar, led we know not by what unae-
' countable influences. But she never
could cease to be guided and cheered by
the light that fills that temple with its re
flected radiance. How she came to fall
into the serious errors of ethical judgment
which must certainly have saddened even
if they lengthened her life we do not care
to ask. But of one thing we are certain :
that should England cease to be Christian
in its worship, under the agnostic theolo
gy of Herbert Spencer, or Christian in its
faith In immortality, under the guidance
of George Lewes, England could never
produce another George Eliot in either
sentiment or imagination.”

the house, from Hall.
Where the evidence showed the pres
ence of tho defendants m a store at night,
that they fled through the front door when
opened by the proprietor, and that certain
articles were gone, but did not show how
they obtained entrance nor any Indica
tion of the use of force, a request to chaige
that if they broke and entered, tbe crime
would be burglary, not larceny, was prop
erly relused. Judgment alflrmed.
Downing vs. The State. Keeping and sell
ing kerosene oil below test, from City
Court of Atlanta.
1. An accusation in the City Court of
Atlanta for keeping and selling kerosene
oil below test, which is in substantial
compliance with the statute under which
it is drawn, is not demurrable because It
does not conclude with the allegation that
the acts charged are contra forrnam stati,
nor because it is not alleged that the de
fendant intended to do such acts.
2. Every sale of kerosene oil below lest
is a distinct offense, and conviction for a
sale to one person is no bar to a - prosecu
tion for a subsequent sale to a different
Person. . .
8. The charge being the sale or oil be
low test, it is no objection to a witness
otherwise competent to testify concerning
such fact, that lie Is not the inspector au
thorized by law.
4. In a prosecution for selling kerosene
below the test prescribed by law, it is- not
an element of the State’s case to prove
that the defendant intended to commit
the offense. When the illegal sale has
been proved, the illegal intent will be pre
sumed, and anything in rebuttal thereof
is proper matter for the defense.
(a.) Where the law prohibits the sale
of oil below a certain test, and provides a
plain and simple mode of making such
test and determining tho saleability of the
oil, ignorance is no excuse for a dealer
who soils oil below the prescribed test.
5. The accusation containing two
counts—one for selling, the other for
keeping kerosene—and the court, for the
benefit of the prisoner, having withdrawn
from the Jury tho second count, it will
not necessitate a new trial that in so doing
he remarked that “there was no evidence
of defendant’s keeping the oil, unless it
might be inferred from the fact that such
kerosene had been sold by defendant.”
Judgment affirmed.
