MAYOR DOZIER*!* TESTIMONY.
The next witness snorn was Mayor D.
P. D< zier. His testimony was about as
follows: “1 was standing inside of tho
railing, close to the Htami, with my bark
to the east, when the firing Legan. By
tl e time I could reverse tuy position an
other shot was iired. I saw four men

ard was about lilteen feet from D&won.
Kobert Howard was about ten feet back
of Kichnrd. 1 did uot recognize tho third
mau at the time.
"I ran to watch Richard Howard. As
I ran I saw Bickerstalf put a hand under
his caat. He pulled out a pistol. I
commanded him, as mayor of the city,
not to shoot.
SHOT HIM AS HE HANK.
“Dawson was sinking. Dickerslaff
fired at him under my arm. I then seized
DiCkerstntf. I aaw Dawron fire three
shots. He was about fifteen feet inside
tlie bicycle ring when he tired the fiisi
shot. It struck me tlmt Dawson was a
dying man whon ho iired tho first sho'.
lie held the pistol us if paralyzed. His
■rin was dose to his Fide when he shot.
Dawson was undoubtedly sinking to the
ground wiien ho was eliot by Bicker-
staff. When Bickerstaif fired Dawson
went down more rapidly.
“I havo Dawson’s pistol Three cham
bers are empty. Robert Howard bought
u lid-calker hommerless Smith A Wesson
pistol from my store last Thurs
day. I could see blood on the
front of Dawson as he ran. 1 considered
him a dying man ut that time.’’
THE. MARK OF TIIE DIRK,
At this, juncture the jury examined
tho clothing worn by Dawson at tiie
time. There were two lulltt holes in
the shirt. Both hobs were round nnd
tolerably dear cut. There was a smooth
cut a third of an inch long in the edge of
the lapel of the vest oo the left side. Tho
blood stained the shirt just beneath nnd
had a smooth cut seven-eighths of an
inch long. The cut in tho J:ipel of tho
vest snd in the shirt was uudouli edly
mado by the same instrument at the
saute time. Tho cut was on the left side,
about Uu Kcliva below the seek and
two inches fr. m the center of the shirt
bosom. The jury fitted the dirk taken
from Robert Howard to tho cut in the
shirt. Tho cut had every appearance of
having been made by the knife taken
from Howard,
