J.—l. Whenever a person, not an
employee, is injured by the run
ning of railroad cars in this Stale,
the presumption is that tbo com
pany is at fault and the onus is on
it to rebut such presumption.
2. The charge of the court should
not express or intimate an ..pinion
on tlie faots of the caso.
3, Ail inquiry having occurred
by tbo plaintiff's jumping from a
train while in motion, after being
informed that it *vu.s not a passen
ger train, and being told (as lie
claimed) to got on, it was error to
charge that reasonable opportunity
must have been allowed him to got
off, and that such opportunity was
not afforded so long as the train
wis in motion.
1- A charge should not assume
as proved facts, not so in fact.
(a). An injury having occurred
while plaintiff was seeking to leave
a moving train after bcig informed
flint it was not a prsseuger train,
under order from the agent in
charge to got off, it was error to
charge that before putting a person
off of a train it must bo stopped, or
the railroad would bo responsible
for damages. The existence of
negligence is for the jury, not the
tom! ) to decide.
• If a conductor or sgent in
ebargo of a train improperly orders
one who gets upon it to leave it
while in motion, and in so doing an
injury occhih, though the party may
have been negligent in obeying the
order, it would not free the compa
ny from liability, but would c insti
tute a caso of contributory negli
gence.
G. To charge the jury that if a
plaintiff did acts which the evidence
showed that he did in fact do, it
would lie an act of carelessness on
his part, and would prevent r recov
ery, although the company may
have been at fault, would have been
error, and a request to charge to
that effect was properly refused.
To have so charged would have
been both to invade tho province of
tho jury in deciding tho question of
negligence an 1 also to have exclu
ded tho theory of contributory neg
ligence.
7, 8. Requests which exclude
from the jury one of tho issues iu a
case should ho refused,
7, 10. While a mere direction at
cottunand by tBo agent of a railroad
company, requiring one who has
entered n train other than a passen
ger train to leave it would not
amount to force, yet if tho latter
acted under fear of it the efljct up
on liis mind is tho same, anil a re
covery for an injury suateinod in
obeying tho or bit would nit bo
prevent and by tho tact that no phys
ical lorco was used.
11. Although a person entering
a wrong train by mistake, on dis
covering his mistake, could have
safely loft the train, tho speed being
then very slow, yet if ho remained
on the train until tho speed became
greater and then under order from
tho agent in charge of tho train
sought to leave it aud was injured,
Uie caso would bo ono contributory
nogligeneo.
12. Though one would not bo jus
tified in jumping from a moving
Irain to avoid paying tho fare de
manded, although exhorbitant, yet
if ho refused to pay such fare and
was ordered to loave the train, and
in so Joint: was injured, such facts
would constitute contributory neg
ligence on part of both himself and
the railroad.

a sponge upon the means of others.
Then teach the child that work is
honoiable, rear him to habits of in
dustry and honesty. The boys of
this country want the moral courage
to stand up and dare to do right.
This mu t come from the training
hand of lather and mother.
Seceding from the union did not
remedy the evils of the union. Se
ceeding from the democratic party
will not rem dy the faults of the
democratic party. Tarty methods
must be improved from within the
party, by its friends ; not from withou t
by its enemies. With all its faults the
democratic party is the purest political
association in the country ; and the
people of Georgia are not fools
enough to destroy it in the interest
