FREIGHT PAYER:
READ THIS
Freight payer, do you know that
“The Railroads of Georgia" admit that
“there are about nineteen hundred ar.d
forty railroad stations (cities and
towns) in Georgia” that are discrim
inated against, under the present
freight rates? These cities and towns
have to pay a higher freight rate than
the remaining cities. How does that
strike you farmers, laborers, and mer
chants in the country towns of Geor
gia? Reader, I feel like that you will
agre> with me when I say that it is a
grave injustice to give one city pre
ferential freight rates over the remain
ing cities and towns. Why? Because
it enables the one that is granted the
lowest freight rate to under sell the
cities and towns that are not granted
an equally low rate, in other words,
the city with the prefered freight rate
prospers at the expense of the cities
and towns that are not granted the
same late.
"The Railroads of Georgia” contend
that they have “suggested for the con
sideration of the Railroad Commission
of Georgia, a system of freight rates
that is believed will eliminate the dis
ci initiations now existing between
the cities and towns of Georgia," but
at the same time they are expecting
“increased revenue” in the “re-adjust
ment” of freight rates.
With“ Nineteen hundred and forty
cities and towns” already paying ex
cessive rates, can any one explain a
‘‘re-adjustment” would eliminate the
excessive rates that these cities and
towns are paying, and at Ihe same
time bring in “an increased revenue”
to the railroads?
If th Georgia Railroad Commission
should grant the increase in freight
rates that the railroads are now ask
ing for, “The Shippers’ Association”
says it will cost the people of'Georgia
approximately $3,000,000 per year.”

SENT 10 JAIL
WITHOUT CAUSE
Editor Tribune:
A prominent citizen of Gordon
county has called my attention to the
fact that Judge A. W. Fite, in his cam
paign for re-election to the judgeship,
has been persistently circulating the
report that the county commissioners
of Murray county and myself volun
tarily went to jail in connection with
the contempt proceedings brought
against us here in September of last
year. This statement on the part of
■Judge Fite is without foundation, and
I desire to submit herewith some of
the facts in regard to the case from
which your readers may draw their
own conclusions.
On the hearing of the cause before
Judge Fite cn the 11th day of Septem
ber, he made the following order:
"Upon consideration of the forego
ing petition and answer thereto, it is
considered, ordered, and adjudged
that the defendants are each in con
tempt of this court, but that they and
each of them may purge themselves
of contempt by discontinuing and with
drawing instanter the special tax levy
for the building of a court house in.
Chats worth, Murray county, and the
publication thereof in The Chatsworth
Times, and paying the costs of this
proceeding. And it is further ordered
that, upon failure to comply with the
foregoing order they and each of them
l>c confined in the common jail of
Murray county until the further order
of this court. This September 11, 1915”
This order was made by Judge Fite
notwithstanding the fact that there
was absolutely no evidence introduced
in the plaintiffs, and the petition .it
self was not sworn to, and therefore
was not evidence. The language of
the Supreme Court on this point, in
reversing Judge File, is conclusive,
as follows:
"Thus we have an ordeT restraining
the levying of a tax, and a sworn an
swer, and uncontiradicted evidence
that the tax had been levied, entered
on the minutes, and copies furnished
to the newspaper, posted at the court
house door, and mailed to the tax col
lector before the defendants had no
tice that the restraining order had
been granted There was
NO EVIDENCE TENDING (emphasis
mine) to show that they acted con
tumaciously or with intention to vio
late the restraining order.”
Thus it will he seen that the order
of Judge Fite was illegal and there
fore without authority, and the de
fendants were within their rights in
refusing to obey same. However, in
order that the case might be reviewed
by the Supreme Court, I personally
webt to Judge Fite and requested him
to allow the commissioners and my
self to make bend. This request he
refused. 1 his :s sufficient to show that
the judge intended that we go to jail,
but if further proof is needed the fol
lowing letter should be conclusive that

gest that he had better leave out the

The above letter is in Judge Fite’s
h; ndwriting and I have the original
letter in niv possession. The corres
pondence was done through Clerk
Robinson on account of Sheriff Mike
Wilbanks being disabled because of a
broken arm. It will be noticed that
the judge modifies his former order
by giving the commissioners and my
self the alternative of leaving the
county.
On September 16th, Judge Fite used
th'- following language in a statement
appearing in the Atlanta Journal: “I
d< sire them (the defendants), as well
as the people of Murray county, to
know that they are paying all ex
penses, including their boaid.”
That wc continued the guests of the
sheriff at the expense of the county
and the pleasure of the judge will be

it is useless to state that the de
fendants did not avail themselves of
the above liberal proposition from the
court. .
So far as I am personally concerned,
that Judge Fite ordered me to jail
without the shadow' of authority, and
made my release dependent upon- a
condition impossible for me to fulfill,
will appear from the following para
graph of the opinion of the Supreme
Court:
“Further, we see no evidence which
authorized the holding of Sellers in
contempt. He was not a commissioner,
and had no authority to -revoke the
tax levy and withdraw the publication,
if he had so desired.”
The opinion here quoted from is the
contempt .case and will be found in
144th Georgia Reports, page 157.
The statement by Judge Fite that
we went to jail voluntarily not only
adds insult tc injury on our part, but
is a challenge to the intelligence of
the people of the Cherokee Circuit,
and anyone who believes that the com
missioners and myself will support
and vote for Judge Fite are capable of
believing anything.
