Cheeks representing a dividend of
.Ajer cent wore sent out Thursday
'by L. G.' Council, receiver for the
Bank of Southwest Georgia, which
failed here four years ago, to about
live hundred depositors in the insti
tution. This dividend brings the to-
cent. This will be tne last payment
of any importance, Mr. Council stat
ing that the live, tangible assets re
maining to be liquidated are minor
and difficult to turn into cash. The
total payment will not exceed 60 per
cent, it is believed. The deposits
amounted to approximately $100,000.
At the time he took charge of the
affairs of the bank as receiver, Mr.
Council estimated that he would be
able to pay the depositors 60 cents
on the dollar.
Co-incident with the payment of
the final dividend of any consequence
came a decision this week in the
Georgia Supreme court disposing of
pending litigation brought by Mr.
Council as receiver against the di
rectors of the defunct bank to com
pel them to make good $76,000 of
the bank's losses alleged to have been
incurred by officers of the bank
through loans to themselves and ex
cessive loans to others without ade
quate security, and for which it was
alteged they were liable under the
law. The Supreme court has sustain
ed Judge Littlejohn of the Sumter
Superior court in his ruling in favor
of the directors. Which means that
there will be no recovery from them
for the benefit of the.depositcrs.
The suit against the directors of
the failed bank was filed November
6, 1017. The defendants were Chas.
L. Ansley. W, E. Brown, W. A. Dod
son, N. M. Dudley, Thomas Karrold
and H. R. Johnson, of Americus, and
A. A. Arrington, of Schley county.
The defense demurred to the pe
tition on numerous grounds, amonj:
them being that no specific acts oi
dereliction were charged against the
directors, who under the charter of
the bank were permitted to delegate
the management of the institution to
the president, who was the late A.
Smith; that no order had been
ined from the court qulhorixing
nit, as required by law; that the
„’b charter had expired in 1910
had never beon renewed, and that
the old charter in itself, authorised
by legislative-enactement by a rider
on another bill, was Illegal. A spe
cial ground of demurrer aot up was
that the petition did not allege that
the directors of the bank knowingly
did anything to affect tho assets of
| the bank. , ... '
Judge Littlejohn sustained the de
murrer and the ruling was appealed,
tho Supreme court’s decision Just
handed down being tho sustaining of
this decision.
Although the case has never come
to trial on its merits, lawyers appear
to be of the opinion that thia ruling
ends the case and closes further litl-
Ration. _

It Is expected that tho entire af
fairs of the defunct bank will be
wound up shortly.
An unsolicited letter came to the
editor today just after the noon hour
from Chas. L. Ansley. During' the
morning sales rush, one of Mr. Ans-
leys clerks stated to our solicitor:
"This Thursday morning special
sales feature that you folks have put
on is great. We are now selling
as much in the half day on Thursday
as we sell on any other whole day
in the six." The letter follows:

I remarked to him that (hat might
do for his business but it would cer
tainly never be attempted in mine
which we had run for a life time on
truth and merit and would continue
on the same line to the end of the
chapter. I understand this same man
ha a practically admitted to some of
his close friends since (hat time that
‘he had lost all of his trade, his busi
ness had gone from him and he could
not' sell any merchandise except at
cut throat prices.

ment for Columbua suffered an over
whelming defeat at the polls Wednes
day, because of the failure of the
