The (Jeorgia Bar AaHociation at its meeting next month will likely recom mend the appointment of Supreme Court Judges by the Governor, all other Judges to be named by the Supreme Court, and the abolition of all City Courts. The committee on revision of the judicial system and procedure will report as follows: Abolish all City Courts; all elective .Justices of the Peace; give the Court of Appeals ex clusive appellate jurisdiction in crimi nal cases, and transfer all civil causes to the Supreme Court. 'This leaves vacancies to be filled as follows: Have Superior Courts hold quarterly sessions for oftener), in all counties, and render judgment at the first term where no issuable defense is filed. Have a County Judge to hold court monthly at the county-site, with juris diction to try misdemeanors und civil cases involving not over $500, with ju ries of six instead of twelve. Ho shall also hold court monthly at each militia district court-ground, with same juris diction as now given by law to Justices of the Peace. The Notary Public and ex-officio Justice of the Peace of the district shall be ex-ofFicio clerk of this court in his district, with authority to issue all papers as now, hut with no other authority, except to hold courts of inquiry. There shall ho no jury trial in any court except it be demanded in original petition or unswer. Cases may he taken by certiorari (and only by that method,) from courts hold by the County Judge to the Supe rior Court, and the judgment of the Su perior Court therein shall be final; un less the Judge of the Superior Court shall certify that some Cohstitutional question is involved which is properly raised in the pleadings at the trial. Civil cases from the Superior Court shall he taken to the Supreme Court, and criminal cases to the Court of Ap peals, as under the present system. The udvunlages claimed by this scheme are: 1. The system will be absolutely uni form throughout the State, (except for the lower courts, as recently created for Atlanta). 2. There shall be but one trial and one review of each case, (except as to Constitutional questions). 8. Judgments may he obtained ns speedily in the Superior Courts as now in the City Courts, and there will be a general expediting of business by rea son of this, and by eliminating many jury trials, which take fully twice &b long ns trials by the Judge alone. A. Making judgment of the Superior Courts final in cases originating in low er courts, and giving all criminal busi ness to the Court of Appeals, would probably reduce the number of cases going to the Supremo Court sufficiently to enable that court to keep up with the business as well as now. 6. Practically all of the present City Court JudgeB (except those in the larger cities) could he made County Judges, and the extra work which would keep them occupied practically all of their time would justify a corresponding in crease in their salaries. 6. The fee system, which is some times suspected of perverting justice, would be eliminated. 7. Have the Justices of the Supreme Court appointed by the Governor, with the advice and consent of the Senate. Have the Judges of the Court of Ap- P'als, and all of tin* Superior Court Judges and County Judges appointed by the Justices of the Supreme Court, and in the event there should be a tie vote of the members of the court, the side on which the Chief Justice votes shall prevail. Commissioner of Agriculture Price will issue a bulletin from his depart ment to-morrow describing crop condi tions throughout Georgia. Speaking of the forthcoming report, which will be bised upon data obtained from many correspondents scattered throughout the State, Mr. Price says: “l am afraid the report will not show a very fluttering outlook for crops just now, the reason for this being the cold, dry weather that has prevailed. 1 be lieve, though, that it is for the eco nomic good of the State that these facts be made known at once. A false expectation of a hump r crop would lead only to a lowering of prices for farm products, which would tie felt by the farmers m-M fall.” The next meeting of the Georgia Pharmaceutical Association will he held at Indian Spring, on June 9 and 10. Many valuable papers will be read, matters of vital importance to every drug ist in the State will he presented, and a general “get together spirit” will be in evidence. Hon. Jas. D. Price, Commissioner of Agriculture, will deliver an address on the occasion, and there will be short addresses from other prominent speakers. The hotels will make reduced rates to members and their families. The railroads will also give reduced rates. The members will be guests of the Macon druggists. Mucon News: “Commissioner of Ag riculture Jas. D. Price has made an ex cellent. record since taking charge of the office, and stands high with the far mers and business men of the State. Mr. Price is a frequent visitor to Ma con, and has a wide acquaintance in Bibb county. When the primary is held on Aug. 19 it is more than likely that he will have a big majority of the votes cast in Bibb county.” The Japanese premier is quoted as saying, in a public address in Tokio the other day, that "America has no ene my; so what is the use of the fortifica tion of the Panama Canal?” Very ami cable sentiment, to be sure, coming from a Japanese source; —at. the same time we will go right ahead with the work of fortifying the canal. Hon. Chas. Henderson, who defeated Braxton Bragg Comer in a run-ofi* pri mary last week for the Governorship of Alabama, is said to be the only bald- headed man nominated to that office since the war. Be it Ordainkp by thr Mayor and Council or mr City or Newnan. Ga.. and it is Hkkkby ordained by Authority or the Same. 1. That the right, privilege and authority are hereby granted to Win. M. Jenkins, of the city of Atlan ta. the State ot Georgia, his associates, successors, or assigns, to construct, own and maintain and operate a gas plant in the city of Newnan for the manufacture, distribution and sale of natural or manufactured gar. for illumination, fuel, power and other purposes, in said city of Newnan. 2. Be it further ordained by said authority, That tho said Wm. M. Jenkins, bin associates* successors and assigns, are hereby authorized and empowered to lay such mains, pipes and fixtures as may he necessary in conducting their business, under the streets, lanes, alleys, sidewalks, bridges, public parks and squares and places of said city, now established, laid out and existing therein, and ulso all streets, lanes, alleys, sidewalks, bridges, public parks and squares und places which may at any time hereafter he laid out and I'Htnhlinhcd by it, or incorporated or included with in the city of Newnan: Provided, that Jill excava tions and laying of pities and fixtures shall he subject to the approval of the City Council of Newnan, or such committee as they may desig nate. und shall be done in accordance with such reasonable rules as they prescribe. 3. Bu it further ordained by said authority, That the suid Wrn. M. Jenkins, his associates, successors, or assigns, shall repave or relay as promptly as possible all streets, lanes, alleys, side walks. squares and places exenvated. dug or dis turbed by thorn in laying pipes, mains, fixtures, or in changing or removing them, or for any other purpose attending such work. And they shall re pair and restore such streets, lanes, alleys, squares, places, sidewalks and pipe to tholr former good and safe condition, und with the same kind of ma terials as were existent before the work com menced. 4. Be it further ordained by said authority. That should Wm. M. Jenkins, his associates, successors, or assigns, neglect or refuse' to repair and restore, without delay, upon reaswnable no tice, any street, alley, lane, place, square or side- walk which may have been excavated, dug or dis turbed by them, their employees or agents, then the City Council or its appointed committee shall have repairs and restoration done, and the ex- pensa incident thereto shall be paid by the said Wm. M. Jenkins, his associates, successors, or as signs. 6. Be it further ordained by said authority. That the said Wm. M. Jenkins, his associates, successors, or assigns, shnll at all times indemnify and hold harmless the city of Newnan sgaloBt all damages, judgments, decrees and costs which inuy arise or accrue to the Haid city from injury to persons or property brought about by the care lessness or neglect in the execution or conduct of the work hereunder authorized, or in tha disre gard of the said parties, their employees or agents, to comply with any ordinance, rule or requirement relative to streets or sidewHlkB now in force or hereinafter enacted; and tho said Wm. M. Jen kins. his associates, successors or assigns, shall and will, well and truly, save the city of Newnan harmless front any dumage either to the city or any person or persons, resulting fram any of its acts or doings, or by his associates, successors and nssigns. 6. Be it further ordained by said authority. That the said Wm. M. Jenkins, his associates, succes sors, and assigns, shall execute with a reliable and responsible surety company an indemnifying bond in the amount of $5,000, made payable to said city, conditioned for the faithful fulfillment of the terms of the preceding section thereof, said bond to be subject to the approval of the City Council of said city. 7. Be it further ordained by said authority, That the city of Newnan reserves the right to change the grades of the atreets, or use them for other purposes; but should it become necessa ry to disturb or remove any gas main, pipe or fix tures. the same shall be replaced at the city's ex pense, as promptly as it can be done, but only af ter notification te said Wm. M. Jenkins, his asso ciates. successors, or assigns, and under their su pervision: Provided, they send some one in a rea sonable time to supervise the same; otherwise, without their supervision; said replacement being dene in a first-class manner, and in as good condi tion ss found. 8. Be it further ordained by said authority, That the gaa works shall be of standard de sign. producing standard gas. vis: Gas with a heating value of not less than 550 British thermal units, and tho said gas works shall be operated so as to maintain a regular and efficient service. 9. Be it further ordained by said authority, That the said Wm. M. Jenkins, his associates, successors, and assigns, shall receive for gas sold and furnished each customer or customers at the rate of not more than ono dollar and fifty cents ($1.50) per thousand (1,000) cubic feet, subject to a discount of 10 per cent, if the bill is paid on or before the 10th of each month: Provided, however, that each customer or customers shall pay a min imum price of one dollar ($1) net per month, whether they use that amount of gas or not. 10. Be it further ordained by said authority. That all of the rights, privileges, powers and grants given in this franchise shall be enjoyed I and be in full force for the benefit of Wm. M. Jen- I kins, his associates, successors or assigns, for a I period of fifty (50) years from the date of the passage of this ordinance. 11. Be it further ordained by Raid authority. That the said Wm. M. Jenkins, his associates, successors or assigns, shall commence work and the construction of the plant within one (1) year after the ordinance shall become a law. and that the said Wm. M. Jenkins, his successors, or assigns, shall be rendy to provide the use of gas | in the principal streets of the suid city within two (2) years after this ordinance shall become a law -subject, however, to floods, fires. Be it further ordained by said authority, That the Mayor and Council Bhall have authority, in the interest of customer or customers, to re quire from Wm. M. Jenkins, his successors or as signs. to extend the service mains and distribu tion pipes into such streets and to such points in ■aid city as may be deemed necessary; Provided, such extension shall not be required except on ap plication of at least two bona fide customers for ; each one hundred feet of gaH main pipe required for such extension, which customers must agree ! to continue customers for at least ono >ear. I 13. Be it further ordained by said authority, j That at the end of each period ef ten years of the existence of this contract and franchise, the city of Newnan has tho right of option in the purchase of the said gas plant, its properties, franchises, rights and privileges, a* follows: Thirty days be fore tho expiration of ten years the city shall, by resolution of its Board of Mayor and Council, no tify tho said grantees of their intention to pur chase. upon which said grantees shall select one 1 disinterested expert, not connected in anyway . with said plnnt. and the city shall select ono ex- [ pert, whoohall not be a resident of Newnan. or Coweta oounty. Ga.. nor n tax-payer in either. These two shall select a third disinterested party or person, and these three, or their majority, shall make the award of the price to be paid by the city. The said board of arbitration shall take into con sideration the original cost, reproduction cost, ac crued depreciation, and present worth of all phys ical properties of the said company, its earnings and prospects, and their award shall include a proper allowance for going concern value, good will, and all other elements whieh go to make up the value of the property. After the award shall have been made and given to the city, the option of the purchase shall remain open for sixty days; but if not complied with within that time the city shall forfeit her right for another ten years, when a new appraisement miy be made as before. 14 Bo it further ordained by said authority. That this ordinance shall be in full force and ef fect from and after its ratification: Provided, that said Wm. M. Jenkins, his successors and assigns, shall file with the Clerk of the city of Newnan within sixty days (60) from the ratification of this ordinances certified check for the sum ef Five Hundred Dollars, ($500l. made payable to the May or and Council of the city of Newnan, together with a written statement signifying his or their acceptance of this ordinance; otherwise this ordi nance shall become null and void. However, should tho said Wm. M. Jenkins, his associates, successors or assigns, begin construction work within the time sot out in paragraph 11, then the aforesaid certified chock for Five Hundred Dol lars ($500) Hhall bo returned to him.
