Atlanta yesterday. One was com
posed of the children of the La-

has blocked the collection of the
district school tax.
In Henry county seven out of
fourteen school districts voted in
favor of local taxation. The Mc
Donough school district had even
gone so far as to build a handsome
new brick school house on the
strength of the vote in favor of the
plan. When preparations were
made to collect the tax an injunc
tion was filed by the Southern
Railway, charging that the bill

McMichael bill. This bill was
passed by the legislature and is in
effect, a law authorizing any dis
trict of any county to tax itself for
better school facilities. The
Southern and Central railroad at
torneys objected to paving the tax
and the result of their fight against
it is recently a decision of the
court knocking it out, which de
cision, however, has been appealed
to the supreme court and must be
passed upon by that body before
the law is rendered invalid.
The railroad corporations, it is
understood, are the only objectors
on record against the school tax.
Over 50 districts in the stale have
already voted to tax themselves
for better school facilities, in one
instance only four votes in the
district being cast against it. The
railroad attorneys, however, de
cided to fight the law on the
ground that it came in conflict
with the law by which the counties
of the state are authorized to as
sess the school tax. The South
ern and Central’s legal counsel in
Atlanta, Dorsey, Brewster & How
ell, were in correspondence with
state officials regarding the tax
for some time, and following
this correspondence suit was
brought in Honry county to resist
the collection of this tax from the
road. Judge Reagan sustained
the contention of the road's at
torneys and if his decision is sus
tained by the supreme court the
school system of the state will
iose all the benefits designed by
the McMichael bill,
It is admitted that the law
should be amended if it is not con
stitutional, but the comment that
is general over the state is directed
in the main against the railroad
corporations which claim to be
such great agents of progress and
advancement but which embrace
the first opportunity to resist pay
ment of their share of an educa
tional tax which all other individ
uals of the state seem perfectly
willing to pay.
The decision of the supreme
court in the matter will be awaited
with considerable interest by the
educational factors of the State.—
