The New Court of Appeals.
Tlie new court of appeals will
begin operation on January I,
11)07, following the regular elec
tion of the three judges in Novem
ber. For some time, at least, this
conrt^irill use the supreme court
room for its sessions, so arranging
tin* schedule that the two courts
will not conflict.
It will open with a docket suffi
cient to keep the three justices
busy, fora large percentage of the
October docket of the supreme
court will be transferred to it.
The terms of the three justices
just nominated will run two, four
and six years. The judges will
determine among 'themselves by
lot who shall have the two, four
and six years. A presiding justice
will be selected by the three among
their own number. As the terms
expire, a new judge is to be chosen
by the people for a full term of six
years. Two will constitute a quo
rum in deciding eases.
The new court will have juris
diction over eases which do not in
volve the constitution of the State
and United States or the constitu
tionality of an act of the general
assembly. When such issues
arise in cases brought before the
court of appeals, that question will
, be referred to the supreme court,
which will render an opinion to
lie embodied in the decision of the
court of appeals. The decisions of
the supreme court are binding on
the court of appeals as precedents.
The court will elect its own
clerk and sheriff. Logan Bleck
ley, for many years the efficient
and popular deputy clerk of the
Supreme Court, will be clerk of
the new court of appeals. That is
a guarantee that Hie machinery of
the court will lie correctly and ex
peditiously administered from its
inception. ,
The stenographer of the supreme
court will sertfe the court of ap
peals until other provisions are
made. •
The salaries of the judges will lie
#4,000 per annum and that of the
clerk of the court will lie the same.'
Itis ultimately the purpose to pro
vide separate quarters for the,
court of appeals. It is not im
probable that the large room on
the third iloor of the eapitol,south
west corner, will lie lilted up for
that purpose. There are several
rooms on this floor that could be
used as pYivate offices for the

Cubans Not Patriotic.
The Cubans, as a rule, are not
patriotic, according to the Phila
delphia Ledger. Speaking of
Secretaries Taft and Bacon and
what they found in Cuba, that pa
per says: “They found, to their
infinite disappointment, that every
patriot had'first and foremost a
private axe to grind, and that he
would sacrifice his country readily
if he were permitted to advance
his own interests. Such shuffling
and shifting, such lying, twisting,
meanness, irresponsibility and dis
regard of country never were seen.
And the people who fomented the
revolution and carried it on were
