to accommodate those friendly com
mercial ties, together with the de
mands of internal and local enliven
iences, have reduced the law con- |
eerning Promissory Notes, to a le
gal science, which may be studied ;
with advantage in the various
codes, and in judicial decisions.
Blackstone, Bay ley, Kent, Story,
and others, have given definitions
of a Promissory Note “us a written
promise made by one or morn to
pay to another or order, or btarer, !
nt n specified time, it specific ain't, j
of money, or other articles of val- I
ue.”
A Promissory note must be sign
ed by the person or persons giving ;
it, nod if tbe person, or persons giv- t
ing the note or either of them can- J
not write, the mark t f such illiter- j
ate person or persons should ho at- j
tested by some one who can write.

negotiable. Only those made paya
ble to a specified person or persons,

All actions upon Promissory !
Notes must be brought within six
years from the time they fall due,
or become payable, unless given un
der seal, and so stated in tho body
of the note, then action may be
brought within 20 years.
If credits arc placed upon the
note at the instance of the maker,
the statute of limitation will com
mence at the date of the last credit
or if written promises are made by
the maker of note, such promise re
vives the original liability; hut does
not create a new one.
As intimated above, notes in
most cases are negotiable (when
payable to order or hearer.) When
a negotiable note is traded the pur
chaser if he receives the note before
it becomes due, and without notice
of any defact, or defense, will be
protected from defense of the mak
er, acceptor, or endorser, except the
plea of of non ext factum; gambling
or immnrrul and illegal considers
tioi ; or fraud in procurment of the
