The Capture of tho Spanish Squadron-
How it Vu Done.
Bayonne, July 22.—Newn received here
through the €arlit* oonoorning the insur
reotion at Cartbagona, throws additional
light on the defection of the Hpaniah
equadron in that jtort, which was made the
subject of a government decree and a rote
in the Cortes yesterday. Tho Insurgents
utter gaining oontrol of the city, seised
the Costello, a strong fort on the west side
of the harbor, less than a thousand yards
fam the entrance, which it commands
completely. This gave them control of
tbs two lower batteries on the shore, at
the mouth of tho harbor. They posted
the red flag of the Commune over the for
t ideations and snnunonod the squadron ,
lying in th% harbor. The crews were in
sympathy with the Insurgents, and the
vessels fell into their hands without oppo
sition.
The chief command is now entrusted to
Pass*, who led the insurrection in the
naval arsenal at Favial, in the province of
Corunna, some months ago.
The vessels thus taken by the Insurgents
are the Victory, an iron-dad of 25 guns;
Pet ram, iron-clad of AO guns; Almsga,
iron-clad of 48 guns; and the steamers
Fernando, Oatelizc, Ferralana and Blasoo
Garay, not classified.
The four vessels first named are among
the finest in the Spanish navy.
THE WAR IN SPAIN—MORE MUTINIES, DEFEC
TIONS AND SURRENDERS.
Madrid, July 22.—1 tis reported that
the Iberian regiment, which the Govern
ment dispatched to Carthagena to aid in
quelling the outbreak there, has mutinied
and joined the Insurgents in a body.
At Victoria there are seven thousand
Republican troops in a complete state of
demoralization and disorganization. Sev
eral of the municipal officers have been
murdered by the soldiers.
The Bepublioan troops at Crargui have
surrendered to the Carlists on condition
that their lives should be spared. In spite
©f the terms 6f the surrender the Carlists
shot a number of them after they had de
livered up (heir arms.
Don Alpliouao has sent to the Spanish
Government a formal proposition for tho
arrangement of a cartel for an exchange of
prisoners.
SPANISH DISTRESSK.S—REVOLT OP THE NAVY.
The ere vs of the Spanish men-of-war
Almanza, Vittorio, Mendez, Nunez, and
Foruoudo el O&tottoo have revolted. The
Government has proclaimed these vessels
pirates, authorizing their capture by any
foreign power on the high seas, and thoir
treatment as pirates.
Decrees have been issued dismissing
Generals Contreas and Pierod, and re
moving the civil governments of Cordova,
Murcia, Ponlevidra, Leon and Orenzc.
General Pavia has been appointed Cap
tain General of Andalusia and Estrama
tluru. Alicante has declared itself inde
pendent.
Important Lew Argument - Can a State
Be Sued.
Reverdy Johnson, in tho matter of the
Bpecial Tax bonds issued by North Caro
lina, after thorough investigation and elab
orate review of the facts, gave it as his
opinion that the bondholders had a good
. and complete remedy to get the interest
paid upon the bonds by applying to the
*U. S. District Court for a mtmdamus to be
diseeted to the Comptroller-General of the
Btate, requiring him to levy a tax for the
payment of past due and maturing coupons.
Mr. Johnson's opinion ia approved by Mr.
Caleb Cushing, and the bondholders will
act upon their advice. Mr. Johnson is in
structed to commence proceedings at once.
At last, then, we may expect an authorita
tive decision upon s clear case made of
the great question, can a State be sued?
Both Mr. Johnson and Mr. Cushing have
made the study of law the labor of their
lives. To great ability they unite an in
dustry uncommon even in the ranks of the
profession of the law. They hold that the
constitutional inhibition against suing a
State is wrong, and they believe that the
current of the decisions shows that their
belief is shared by the highest tribunal in
the land. The bonds were issued by the
Legislature, and at the same time an act
was passed requiring a special tax to be
levied annually for paying the interest. A
succeeding Legislature repealed this act,
and disowned the bonds. But say Messrs.
Johnson and Cushing, the repeating act
came after the negotiaton of the bonds, it
deprived boon fide purchasers for value of
vested rights, and it is therefore, retroac
tive, unconstitutional, null and void. The
. theory upon which these lawyers proceed
1 is this: that though there is an amendment
to the United States Constitution, which
prevents a Btate being dragged into a
court of justice like an ordinary debtor,
still such amendment is wrong and will be
evaded by the courts, though they dare
not disregard it openly. Gathering the
bias of the court from the case of Gaines
vs. Chisholm and the case against the Au
ditor of Ohio, they assert that unless the
Btate is by name n party to the record, the
suit will be sustained.

The Savannah Daily Moazixo Nrwaitacknowl
edged by the Presa and people to be the best
daily paper south of Louisville and eaat of New
Orleaaa. Carrying with it the prestige and reli
ability of age, it has all the vigor and vitality at
youth, and its enterprise as a gatherer of the
latest and freshest newt has astonished its con
temporaries and met the warm approbation of
the public.
During the year 187S, no expense of rime, labor,
and money will be spent to keep the Mousing
News ahead of all competitors in Georgia jour
nalism, and to deserve the flattering encomiums
heaped upon it from all quarters. There has, at
yet, been no serious attempt made to rival the
special telegrams which the News inaugurated
some years ago, and the consequence is, that the
reader in search of the latest intelligence always
looks to the Morning News. The telegraphic ar
rangements of the paper are such that the omis
sions made by the general presa reports are
promtly and reliably supplied by its special cor
respondents.
Tho Morning News has lately been enlarged to
a thirty-six column paper, and its broad scope of
type embraces, daily, everything of interest that
transpires in the domain ofLiterature, Art,
Science, Religion, and general intelligence; giv
ing to the reader more and better digested mat
ter than any other paper in the State.
It is perhaps needless to speak of the politics
of the Hohsi.no Newb. For years and years—in
deed since its establishment—it has been a repre
sentative Bouthem paper, and from that time to
the present, in all conjunctures, it has consis
tently and persistently maintained Democratic
State* Rights principles, and labored, with an
ardor and devotion that know no abatement, to
promote and preserve the interests and honor of
the South.
The special features of the Mominww News will
be retained and improved upon during the en
suing year, and several new attractions will be
added.
The Georgia news items, with their quaint and
pleasant humor, and the epitome of Florida af
fairs will be, continued during the year. The lo
cal department will be, as it has been ter the
past year, the most complete and reliable to be
round in any Savannah paper, and the commer
cial columns will be full and accurate.
The price of the Daily is *IOOO per annum;
*8 00 for nil months; *1 00 for one month.
The price of the Tri-Weekly News is *6 00 per
annum, *3 00 lor six months, and *IOO for three
months.
