NOTICE OF SALE UNDER POWER
CONTAINED IN SECURITY DEED
STATE OF GEORGIA,
COUNTY OF HOUSTON
Pursuant to a power of sale
contained in a certain Security Deed ex
ecuted by Frederick E. Diehl and Betty
D. Diehl hereinafter referred to as
Grantor, with the singular including the
plural, to Great Southern Federal Sav
ings Bank recorded in Deed Book 653,
beginning at page 500, of the Deed
Records of the Clerk of the Superior
Court of the aforesaid State and County,
by virtue of a default in the payment of
the debt secured by said Security Deed,
the undersigned attomey-in-fact for the
aforesaid Grantor (which attorney-in-fact
is the present Holder of said Security
Deed and Note) will sell before the door
of the Courthouse in said County within
the legal hours of sale, for cash, to the
highest bidder on the first Tuesday in
May, 1990, the property which, as of the
time of the execution of said Security
Deed, was described as set forth in the
attached Exhibit ’A*.
All that certain property situated and
being in Land Lot 137 of the Fifth (sth)
Land District of Houston County, Geor
gia, which is known and designated as
Lot 31, Block "B", Section No. 1, Valle
Venado Subdivision, according to a plat
of said subdivision which is of record in
Plat Book 14, Page 279, Clerk's Office,
Houston Superior Court. The said
recorded plat is incorporated herein by
reference for all purposes.
Said sale will be made subject to the
following items which may affect the title
to said property: All valid restrictive
covenants, easements and rights-of
way appearing of record, if any; all valid
zoning ordinances; matters which would
be disclosed by an accurate survey or
by an inspection of the property; all out
standing and/or unpaid taxes which may
be liens upon the property; all outstand
ing or unpaid bills, charges, expenses,
and assessments for street improve
ments, curbing, garbage, water, sewage
and public utilities which may be liens
upon said property. To the best of the
undersigned's knowledge and belief, the
party in possession of the property is
believed to be Nancy R. Morse.

On the 2nd day of November, 1987,
William E. Hathcock and Kimberly Ann
Hathcock, executed a deed to secure
debt in favor of Crossroads Bank of
Georgia, securing a note of even date on
the original principal amount of
$46,000.00, said indebtedness being
due and payable in accordance with the
terms and conditions contained in said
note, said security deed being of record
in Deed Book 787, Pages 596-599,
Clerk's Office, Houston Superior Court.
By virtue of the power of sale con
tained in said deed to secure debt, there
will be sold by the undersigned at public
outcry to the highest and best bidder for
cash before the Courthouse door of
Houston County, Georgia, within the le
gal hours of sale, on the first Tuesday in
May, 1990, same being May 1, 1990,
all of the following described property:
All that tract or parcel of land lying
and being in Land Lot 18 of the 10th
Land district. Houston County,
Georgia comprising 0.803 acres as
more particularly shown on a plat of sur
vey designed "Survey for William E.
Hathcock and Kimberly A. Hathcock"
prepared by Richard E. Jones, Sur
veyor, on March 21,1984. A copy of
said plat being of record in Map Book
26, Page 247, Clerk's Office, Houston
Superior Court. Said plat and the
recorded copy thereof are hereby made
a part of this description by reference
thereto.
A dwelling house and other improve
ments are located on the above de
scribed property.
The debt secured by said deed to
secure debt has been declared due be
cause of default in the payments
thereon, and in the due performance of
the covenants therein contained, as well
as failure to make the payments on the
promissory note and deed to secure
debt as above described. The debt re
maining in default, this sale will be made
for the purpose of paying same and all
expenses of the sale, including reason
able attorney's fees.
Said property shall be sold as the
property of William E. Hathcock and
Kimberly Ann Hathcock and their suc
cessors in title, subject to outstanding
ad valorem taxes, easements, and as
will otherwise appear on the public
records in Houston County and other re
strictions of record. To the best of the
undersigned's knowledge and informa
tion, the above described property is
presently in the possession of William E.
Hathcock and Kimberly Ann Hathcock.

has been provided in accordance with
the provisions of the aforesaid Code
sections.
The undersigned will execute a deed

William D. Smith, Jr., dated November
26,1986,and recorded in Deed Book
745, page 119, Houston County Deed
Records; the holder thereof pursuant to
said Wrap-Around Deed to Secure Debt
and Wrap-Around Note thereby secured
have declared the entire amount of said
indebtedness due and payable and, pur
suant to the power of sale contained in
said Wrap-Around Deed to Secure Debt,

This foreclosure sale is subject
and subordinate to a first encumbrance
against said property in favor of CEN
TRAL BANK OF GEORGIA, dated
November 15, 1984, and recorded in
Deed Book 633, page 685, Houston
County Deed Records. The sale will also
be held subject to all unpaid taxes, as
sessments and restrictions of record, if
any.
Notice has been given of intention to
collect attorney's fees in accordance
with the terms of the Wrap-Around Note
secured by said Deed.
Said property will be sold as the
property of Lister Harrell and Michael
Fields, the property, to the best
information, knowledge and belief of the
undersigned, being presently in the
possession of Lister Harrell and Michael
Fields, and the proceeds of said sale will
be applied to the payment of said

February 24, 1988, and recorded in Deed
Book 797, Page 439, Houston County
Records, the holder thereof pursuant to
said Deed and Note thereby secured has
declared the entire amount of siad in
debtedness due and payable and , pur
suant to the power of sale contained in

back to the point of the property to be

and is further described in a plat of sur
