the Clerk of the Superior Court of
Houston County, Georgia, which was
assigned to Harvey A. Jones by McNeal
Construction Co. recorded in Deed Book
929 pages 607-609 in the Office of the
Clerk of the Superior Court of Houston
County, Georgia, the undersigned will
sell at public outcry during the legal
hours of sale before the door of the
courthouse in Houston County, Georgia,
on the first Tuesday in January in 1993,
to the highest bidder for cash, the
following described real property:
All that tract or parcel of land situate,
lying and being in Land Lot 151 of the
Fifth Land District of Houston County,
Georgia, being known and designated
as Lot 36, The Hamptons, as shown on a
plat of survey prepared by Robert L.
Story, dated March 8, 1990, recorded in
Map Book 38, page 107, Clerk's Office,
Houston Superior Court. Said plat and
the recorded copy thereof are hereby
made a part of this description by

The above-described property is
conveyed subject to the following
matters, to wit: (1) Declaration of
Covenants, Conditions and Restrictions
of The Hamptons, dated March 27,
1990, recorded in Deed Book 875,
Pages 194-214, Deed Records of

Easements for drainage, utilities and/or
access and other survey matters as
shown on that certain map or plat of

and (3) Deed to Secure Debt and

Construction Co. to CB&T Bank of

127, Deed Records of Houston County
Georgia, securing an indebtedness in
the original principal sum of $39,000.00,
which is hereinafter referred to as the
"Prior Security Deed".
The Debt secured by said Security
Deed is evidenced by a Security Deed
dated April 18, 1991 in the principal
amount of $42,543.33 executed by
Randy A. Dancy in favor of McNeal
Construction Co. McNeal Construction
Co has assigned said Security Deed to
Harvey A Jones.
The debt secured by said Security
Deed and evidenced by said Security
Deed has been and is hereby declared
due and payable because of grantor's
failure to comply with certain terms and
conditions in said Security Deed. The
debt remaining in default, this sale will
be made for the purpose of paying said
indebtedness including all accrued and
unpaid interest thereon and attorney
fees and all expenses of said sale.
The property will be sold as the
property of Randy A. Dancy, who, to
best of the undersigned's knowledge
and belief, is the party in possession of
said property.
Notice has been given of intention to
enforce provisions for collection of
attorney fees and foreclosure in
accordance with legal requirements and
the terms of said Deed to Secure Debt
and Mortgage note.
Said property will be sold subject to
any and all unpaid taxes, assessments,
