Application Refused.
The ease of John W. Defararri vs. H.
Gregory et. aL, application for receiver,
came up before Judge Kimsey in cham
bers in this city Tuesday. The plain
tiff endeayored to have the Thompson
mine in White county, said to be one
of the richest mines in the State, pnt
in the hands of a receiver, alleging that
the business was not being, properly
conducted. After hearing the testi
mony Judge Kimsey refused the appli
cation and dismissed the case. Mr.
Fulton Colville of Atlanta, represented
the plaintiff, and Col. H. H. Perry of
Gainesville, and CoL Oakes of Cleve
land, represented the defendants.
A MEMORIAL.
To the Chiefs and Members of Chatta
hoochee Tribe, No. 19, Improved
O. R M.:
We, your committee appointed to
prepare a suitable memorial on the
death of onr Brother, S A. Clark, re
spectfully submit the following:
Brother Clark was born December 24,
1863,. died November 13, 1897. He
leaves a loving wife, and two children,
also father and mother, and several
brothers and sisters to mourn his loss.
Brother Clark was a quiet and peace
able citizen, ever willing to discharge
every duty possible to his Tribe, friends
and family. He became a member of
our Tribe March 5, 1891, and has ever
cherished the principles of Freedom,
Friendship and Charity. While we,
all busy with the hurry and excitement
of the hunt, his gentle spirit quietly
slipped over the river. The voice of
our brother is hushed in death, no
more shall he be heard in our Councils,,
for his spirit’ has ascended to the Great
Spirit who gave it. ' And while we drop
a tear of sympathy, and mourn the loss
of one for whom wej have felt a frater
nal regard, let us cherish his memory
and imitate his virtues, and profit by
this afflicting:? dispensation of the
Great Spirit. ^Therefore, be it resolved,
1st. That M the death of Brother
Clark, our Tribe has; lost a worthy
brother, and we are sadly bereaved.
„ 2nd. That bis parents, brothers and
asters, have been afflicted T>y a wise
Providence *with a great grief in the
loss of a son and brother.
3rd. That his wife has suffered the
loss of a kind and affectionate husband,
and bis children a kind and loving
father, and. we extend to them onr
deep and sincere sympathy - in this,
their great sorrow.
4th. That this report be spread on
the minutes of our Tribe, and a copy
be furnished: the family, and The
Georgia Cracker be requested to pub
lish the same.

ville was burned at about 12 o’clock
Tuesday night. The fire department
turned .but, but the flames had gained
too much headway to be put out. The
loss was total, as there was no insur

Mr. Alek Nelson, who came to Gaines-
viHe several weeks ago from Naslmlle,
Tenn., has. leased New Holland Springs
and will have charge ef this onCe fa
mous resort for, another year. He ex
pects to improve the property and rim
the hotel in proper style next season.
He is very much pleased with New
Holland Springs, and as he is an ex
perienced hotel man no doubt he will
have a successful season with it.
