Roberts and J. R Hutcheson that they claim a lien as atlo neys at law on the following des cribed realty as the property of J. S’ Lehman and against said J. S. Lehman and said property parts of land lots number 154, 155, 1(18 and 1G1 in the 1st. district of originally Carroll, now Douglas, County, On. coutainii g in the aggregate 358 acres, mol cor less and known as the John W. Nixon old place near Alexander,a old mill on Sweet- wuter creek in said County, for the Is frozen fish fresh fish? - This question came recently before the king’s bench division of the Eng lish courts on a question of freight rates. The railroad claimed the right to classify the fish as fresh fish with in the meaning of that description in the railway rates. The respondents, on the other hand, contended that- the fish should be classified as "pre serves (fish, fruit, meat and provi sions) in casks, boxes or cases.” The fish consisted of salmon caught in Alaska and British Colum bia. The connty .court judge decided that the fish was not fresh. The de scription of frfJsh fish in class 4 pointed to fish which would have to be promptly sold if it was not to be come worthless. ’The care necessary in dealing with stieh fish would be greater than that reqrtfvsd with the fish in this mm. ■ He *»nld hot see why freesing shoaid net be held to be just as much a preserving process as salting or drying. The word “pre serving" covered, in hie opinion, every method by which an article was kept from putrefaction, and one such method was that of freezing.
