DISCRIMINATIONS ALLEGED
AGAINST NORTH -A SOUTH STEAM
SHIP COMPANY.

A temporary injunction has been
granted by Judge Cann restraining the
Central of Georgia from making alleged
unjust discriminations in freight rates
against the North and South Steam
ship Company and in favor of the
Ocean Steamship Company and the
Merchants and Miners Transportation
Company. The company is ordered to
show cause why the injunction should
not be made permanent.
The application for injunction, to
gether with a damage suit for $690.90,
w*as filed on behalf of the North and
South company yesterday by Osborne &
Lawrence. The petition alleges that
unjust discriminations are made
against the company and in favor of
the other companies named for the
sole purpose of forcing the North and
South out of business. The specific
instances of these alleged discrimina
tions are stated as follows:
It is claimed that when shippers of
naval stores desire to ship their goods
over the lines of Ocean Steamship
Company or of the Merchants and
Miners Transportation Company that
they are charged five and one-half
cents per barrel for storage and ter
minal charges, including wharfage,
rolling, and towage. When they are
shipped over the lines of the petition
ers, however, there is the same charge
of five and one-half cents per barrel
for wharfage and rolling, but also
charges an additional price of four
and one-half cents per barrel for tow
age.
Asa result of this discrimination the
North and South line is compelled to
offer merchants a rebate of four and
one-half cents per barrel in order to
secure their business. Asa result of
this rebate they have lost, in different
shipments, a total of $690.90, and it is
for this sum that they ask damages,
and which they seek to recover.
Holding of Lumber.
It is further phhrged that the Ocean
Steamship Company discriminates
against the North and South line, in
that it holds up its lumber and cotton
shipments, and will not allow it to use
the wharves which are most convenient
to the railroad.
It is claimed, that though the peti
tioners have the right, upon payment
t>f the dockage and wharfage rates
prescribed by law, to dock their ves
sels at the point of delivery by the
Central of Georgia; that the railway
has refused them such privilege. Had
this privilege been allowed, there
would have been no of lighter
age or other terminal char'geS.
It is further contended that lumber
shipments for petitioners have to pass
over the lines of the Central through
their yards. When the shipments thus
made are consigned to either the Ocean
Steamship Company or the Merchants'
and Miners' Company they are prompt
ly delivered, but if consigned to the
North and South 'Company, it is al
leged that the shipment is held up for
from twenty-four to forty-eight hours.
Delay Cotton Shipments.
A similar delay is caused when cot
ton is shipped to the petitioning com
pany. Cotton shipments, if to be
shipped over the lines of the favored
companies, are delivered at the ves
sels’ sides without terminal charges.
If. however, the shipment is to be
made over the petitioner’s lines, then
tinless the shippers or the petitioners
in the above cause pay the cost of
towage and other terminal charges.
The plaintiffs allbge that they have
no other remedy at law than the one
sought and in order that they may
not be compelled either to go out of
business or lose heavily in order to
compete with the two more favored
lines, they ask for the temporary and
permanent injunction and that the
court allow them to recover from the
railway the moneys lost on account of
the alleged discriminations.
ANNUAL MEETING! OF
THE SOUTHERN RAILWAY.
Nearly All of the Share* Were Rep
resented.
Richmond, Va,, Oct. 11. —The elev
enth annual meeting of the stockhold
ers of the Southern Railway Company
was held in the office of the company
in this city to-day. Out of the total
capital stock of 1,800,000 shares, 1,799,-
000 shares were represented in person
or by proxy.
The report of operations for the fis
cal year ending June 30, 1904, was rati
fied and approved. The proceedings
of the board of directors since the
date of the last annual meeting of
stockholders, Oct. 13, was approved and
confirmed.
Adrian Iselin, Jr., Charles Lanier,
Kdmund D. Randolph and James T.
Woodward were elected directors of
the third class for the term of three
years, expiring In 1907.
LOCAL PERSONAL
Capt. Henry Blun left for New York
yesterday morning, called there by the
critical Illness of Mrs. Blun.
Miss Mary Roe Nugent, who was
dangerously ill from typhoid-pneumo
nia while visiting at St. Anthony's
Convent in Boston, has so far recover
ed as to be able to return home. Mrs.
Thomas Nugent, who was summoned
to the bedside of her (laughter, is ac
companying her to Savannah. They
sailed from New York on the City of
Memphis yesterday.
Among the prominent gentlemen In
attendance at the meeting of the
Georgia Interstate Saw Mill Associa
tion yesterday was Mr. J. D. Long,
senior editor of the New York Lumber
Trade Journal. Mr. Long is well
known in Savannah because of his
numerous visits to this city. He will
remain in Savannah' to-day and ex
perts to make another visit to this
city within six weeks.

An application for incorporation as
the “Fraternal Union of Georgia” was
filed yesterday In the Superior Court
by Messrs. Thomas L. Hill, W. T.
McDonald. T. S. MacGlashan. C. W.
Rarber, and i,. Steinberg. The peti
tion states that the objects of the so
ciety are fraternal and for the mutual

WHAT THEY SAY ABOUT
JOHN ROBINSON’S CIRCUS.
The John Robinson circus will be In
Savannah to-morrow and Friday. This
is what the Atlanta Constitution said
the day after the show was in Atlanta:
It was one of the best shows that
has ever visited Atlanta, and those
who saw the splendid performances
are unanimous in expressions of ap
proval. The big tent was crowded
during all four of the performances,
and from the ticket wagon end as well
as from the ringside viewpoint the
show in Atlanta was a success.
Incidentally Mr. Robinson has made
many friends in Atlanta, and he ex
pressed himself as very much pleased
with his reception here.
Among the acts that secured tu
multuous applause during the per
,° r ,??' lnces of yesterday was that of
A\ illiam DeMont, the famous bare
back rider, who was with Barnum &
Bailey in Paris, and who proved yes
terday that he is indeed skilled above
all others in the ring.
“Miss Gertrude, on her calico cake
walking horse, was given enormous
applause. Particularly was this true
of the afternoon performances, when
the tent was crowded with ladies and
children.
“Probably the most thrilling act of
the Robinson shows is that of Gordon
Orton in his “cloud swings,” an en
tirely new act, which, without doubt,
is the most intrepid and skillful of its
kind.
“Miss Edna, the lady bareback rider,
was the personification of grace and
daintiness and richly deserved the
applause she secured.
“The elephant act. put on by Trainer
Titn Buckley, left them all talking.
For swift action and for bringing out
the best that is in the large but intel
ligent mammal, the act has never been
equalled in Atlanta.’’
UNTROUBLED BY WORK.
Ed Walker Found Guilty of Aannulf
and Battery.
Ed Walker, colored, charged with
assault with intent to murder, was
yesterday declared guilty of assault
and battery. Judge Cann sentenced
him to pay a fine of $75 or in lieu
thereof to serve nine months on the
chaingang. The evidence brought out
by the State showed that Walker had
been riding on a railroad train when
he was caught by a brakeman and
ordered off. Later he attempted to
break the brakemafi’s head with a
brick.
In pronouncing sentence Judge Cann
said: “You seem to be a negro that
is not troubled with work. In the
first place you had no business on that
railroad train and the brakeman did
perfectly right in putting you off. The
assault which you made upon him was
causeless and unprovoked. If you can
not make an honest living then you
had better leave this county, for if you
come before me again I shall impose
the limit of the law.”
CITY BREVITIES.
The October meeting of the board of
directors of the Board of Trade will
be held this afternoon.
Charged with stealing lumber from
the city of Savannah, Josephine Hay
wood. a negro woman, was arrested by
Patrolman Cowart yesterday morning.
The lumber was taken from Farm
street, where it was being used 1n the
repair of a broken sewer.
