the Immanent Reason of the world,
therefore, that obligation to obey the
laws of tho state is strictly limited by
that wblch gives It validity. No man
may rightly be called oil to disobey
the law of right. Men may cavil over
this as much os they like.. They may
seek to sidetrack the matter by ask
ing who Js to be the Judge of what
Is right, and all that. Tho truth re
mains that while one may be mistaken.
In any particular cose, as to what la
right, we can not be mistaken in the
principle of the supremacy' of tho un
written law of right. Rellglouely ex

things which are Caesar’s, but unto
God those things which are God's.”
Obey tho state within Its rightful Ju
risdiction; but do not sell your soul,
do not throw away your manhood for
the sake ot a statute which one sot of

article. What Is the bearing of these

ing a man for murder? Distinguish,

tion. I am qulto willing to bo held
responsible for these principles, but not
for what you may think Is a legitimate
and logicst application of them. More
over. I will give what I think—Just
what I think—the application Is In the
matter referred to. Here. then, la n
law upon the statute books which says
that a tnan who kills another under
certain circumstances commits murder.
The law enumerates certain things
which Justify killing another and pre
vent that killing front being murder;
self-defense, for example. . It does not
Include within this list one of the ex

and takes oath to administer the writ

the right and the duty of shooting down

his home. Ought the Jury In such case,
in the name of the "unwritten law.” to
acquit the prisoner? I have admitted
that there Is n higher law titan the

derives Its binding moral fqrce. Whnt
Is the true analysis of the case under
consideration? In the flrst place, the
jurors have taken an oath to enforce
the law as It Is on the statute books. >t
Is plain, then, that the higher law de
mands that they'must preserve their
oaths Inviolate. No sophistry can get
around this. It is the business of an
honest man who really believes that
there Is' a higher law wblch makes
tha law of the state wrong, frankly to
tell the Judge, before he gets on the
jury, that he Is not going to enforce the
law oa the Judge gives it to him. If he
does not do this, he I* not only a rebel
against the authority of the state, but
he Is a perjured liar to boot. Of such
it can only be said:
"His honor rooted In dishonor stool,
And faith unfaithful kept him falsely
true.”

It Is quite possible. In Itself, that tho
law ot the state may be wrong: but
that Is not the point hero. If a man
thinks It is wrong lie can not, as an
honest man, swear that he will obey It
That is the flrst and most elementary
application of tho higher or unwritten
law—a kindergarten lesson In truth
fulness.
Another consequence follows from
tho supposition that the law of the
etato Is wrong In this particular—that
ts, In not allowing a certain plea ot
defense as valid. That consequence
Is just as obvious and Irrefutable as
the other, and It la thla: It the law ot
tho state Is wrong, It ought to be made
right. If It Is right, according to the
Eternal Law of Right, for a man to
take the matter of punishment Into
his own hands and to visit death upon
the offender, then let the statutes of
the state so declare. It Is the business
of th* state to enact the unwritten law,
so far as that comes within the proper
domain of the stats. Let the law state
that under such and such circum
stances a man shall have the right
and duty to kill another, but let no man
be permitted to wrest Justice from the
state.
. No state can. wttltout committing
suicide, permit an individual to take
the law Into his own hands. The ap-

along the line of progress and tried to
block It. The growth of civilisation
has been along the line of substituting
public justice for private revenge. The
present state of things Is intolerable.
The law should be enforced or changed.

William K. Rakes and Grover Beamer,
alleged to be members of a mob of II

to death Ann* Hall and injured Jane
Hall, hor sister, at their home near
Charity. Patrick county. At about I
o’clock In the morning a mob sur
rounded the house of the two women,
who were alone, and riddled It with
bullets. Anne I(all. who was about (0
years of age. was Instantly kilted, Jane
Hall was shot in the arm, sustaining
serious Injury.
