JUDGE JOHN T. PENDLETON
To the Voters of Fulton County:
We beg a careful consideration of this communication in the
interest of Hon. John T. Pendleton, who is a candidate, by request,
for re-election at your hands as Judge of Fulton Superior Court.
We feel at liberty to freely express our convictions, with refer
ence to the fitness of Judge Pendleton in this communication, as it
is prepared without his knowledge or concurrence. We are alone
reponsible for its contents.
Fortunately, with reference to Judge Pendleton’s character,
there is nothing unknown. There are no charges to explain, to ex
cuse, or meet, for none have ever been lodged against him, either
as a man or a judge. In his entire life there has never been a sug
gestion of either accusation or scandal.
When sixteen years old he joined Gen. Forrest’s cavalry and
served with him and Gen. Wheeler until his capture about one
year before the war closed. He was a prisoner of war when peace
came. He afterward graduated from the Washington and Lee
University, his diploma being signed by his old commander, Gen.
Robert E. Lee. He came to the Atlanta bar in the Seventies,
where his rugged honesty, signal ability and tireless industry speed
ily yielded him recognition as one of the leaders. Important, dif
ficult and responsible litigation sought his services. A somewhat
unique tribute was paid him by his fellow members of the bar in
that he was associated with them in more cases than probably any
other attorney then practicing. He was soon elected Assistant
City Attorney, and in that capacity tried most of the cases in
which the city was a party. le was one of the ablest and most
successful legal representatives Atlanta ever had-—a compliment,
for this city has always enjoyed legal services of high order. After
several years he resigned and resumed a general practice where
his ever increasing ability and experience yielded greater and more
important results.
His position and talents had become so clearly established
that, when Hon. J. H. Lumpkin was appointed to the Supreme
Court, he was selected as the successor and made Judge of our
Superior Court.
His career as Judge has kept even pace with his life as an ad
vocate. Fearless, impartial, able, efficient, recognizing always that
the office imposed great and grave responsibilities, he has become
widely known as one of the best trial judges in the State. His
record for efficient, practical, rapid, administrative abilitiy is
equalled by but few judges in Georgia. A splendid tribute was
Daid him as a judicial officer when 95 per cent ol the active mem
bers of the local bar recently petitioned him to stand for re-election
and voluntarily pledged their support. This event was quite sig
nificant. for cordial co-operation and mutual respect must exist be
tween the bar and the presiding judge before the business public
can reap the results to which it is entitled.

We venture the assertion that no party, witness or juror, ever
took part in a trial in his court who will not testify to the prompt
ness and ability with which he has discharged the duties
of the office. You have probably attended his court in one of the
capacities mentioned and have personal knowledge of this matter.
One of the necessary qualifications of this position is business
capacity and experience, for, without it, the office can not be admin
istered satisfactorily. This element is frequently overlooked.
A very large per cent of the taxes paid by you goes to the pur
chase and building of court houses, to the payment of sheriffs, bai
liffs, witnesses, jurors, salaries, etc. A still greater sum is repre
sented by the proper handling and disposition of the property in
terests that are presented for trial and determination. A judge
may be impartial, but if he is incompetent the extent of the injury
resulting from his honest error is difficult of computation. The
Superior Court of the County disposes of business matters aggre
gating annually millions of dollars, and it means many dollars lost
.to the litigants and the tax payers if the judge is not up to the mark.
The selection ot a judge for Fulton Superior Court is a mat
ter of grave importance. The offlice requires a man who has dem

We present, in Hon. John T. Pendleton, a man who has fur
nished the public ample evidence that he possesses all these quali
fications.
There is nothing unknown, untried, untested about him. He
stands out distinctly, vividly, for what he is. Time and public
office have applied the test—he has made good.
He is a correct, high strung, brave gentleman; a splendid law
yer; a capable, just judge, with wide business experience.
He is a live, virile, active, powerful potentiality and a valuable
asset to the bar, bench, peace, good order and business interests of
Georgia.
He has made you for six years an honorable and an honored
judge.
Let’s don’t grope in the dark for unknown, untested, untried,
undemonstrated experiments. There is no present need for exper
imentation.
