PATTERSON WINS

State Committee Invalidates
Primary in Gilmer Because
of Evidence of Fraud.
The state Democratic executive com

dated tlie late- judgeship primary iu
Gilmer county, and declared H L. Pat
terson, of Forsyth county, the rightful
nominee of the Blue Ridge circuit, in
stead of Judge A. Newt Morris, of <’ohb
county, who was winner by some 500
majority, on the face of the returns.
The committee, after a hearing which
lasted two days reached a verdict, aft
er all evidence and argument had been
submitted, uicin a motion of Commit
teeman Alexander A Lawrence, of
Chatham, that the contesting petition
of Patterson be denied, and that Morris
be declared the nominee of the primary.
The Lawrence motion was rejected
by a vote of 29 to 9

A motion was then made to order a
new primary in Gilmer, and this, too,
was turned down by the committee.
Finally, Patterson was formally de
clared the party nominee by a unani
mous committee vote.
The Lawrence motion had told the
story.
The committee voted in executive
session, but lined up on the iAwrence
motion as follows.

Commissioner Thinks Increase
in Returns Will Bring in Suf

The tieginning of Fulton county's new
fiscal year, October 1. will find the same
rate of taxation in effect, in all probabil
ity It is believed among county offi
cials that there will be no change of the
rate at Tuesday's called session of the
county commissioners.
"1 believe there will be no change at all
in the rate, but I am not certain.” said
Shelby Smith, one of the commissioners,
today.
"The tax returns of the county this year
show an increase of about $13,000,000,
and this amount will bring in more than
$65,000 In taxes. An even larger increase
probably will he made next year, so a lay -
man naturally would conclude that there
is no necessity for the Increased rate.
“But we can not do this thing by guess

DEPEW WILL TESTIFY
OF CAMPAIGN MONEY
AND STUMP FOR TAFT
LONDON, Sept. 6.—Sailing a week
earlier than he had planned, Senator
Chauncey M. Depew and Mrs. Depew
have boarded the Asiatic for America,
so that Mr. Depew m'ight take the
stump for President Taft and also ac
cept a smbpena to appear before the
senate committee investigating the
Penrose charge.
"I expect to testify the day after my
arrival,” Depew said. "I don't know
just what I can tell them other than
that I was active in the 1904 campaign
and personally contributed to the cam
paign fund. 1 had many talks with
Colonel Roosevelt during that cam
paign, but h. never mentioned the sub
ject of contributions to me.”
Mr. Depew declined to state what
amount he contributed.
"I have seen statements that as
much as $12,00<1.000 was raised by the
Republicans in 1904," he continued.
"Such talk is absurd. The total of
contributions in the last six campaigns
would not aggregate that amount.
Probably the blegest,election fund ever
raised was $.3,000,000 collected by Mark
Hanna for McKinley in 1896.”
