MAYOR WILL VETO IYYST.BMT Winn Says Project Would Take Too Much of the City’s Future Income. Mayor Winn will veto the Ivy street improvement project when it gets to him, according to a report among councilmen today. His reason is that an approval of the plan would appro priate, future revenue of the city and that too much of the future revenue already has been apportioned. The mayor thinks the “moral obliga tion” scheme is being overworked. While the aldermanlc board yester day afternoon adopted the resolution, passed at the last meeting of council, providing that the regrading and re paving of Ivy street be begun as soon as the work at the junction of the two Peachtrees is completed, Aiderman John E. McClelland used his official prerogative to hold up final action for two weeks. Agree on Georgia Avenue Work. After Aiderman McClelland made his motion, Aiderman John S. Candler, who Is also mayor pro tern, said that he would have vetoed the project if It had come to him as acting mayor. The board approved the plan to take $3,000 from each of the funds to im prove Fair street and Boulevard and apply it to the work of regrading Geor gia avenue. Final approval of this project is up to Mayor Winn. Both of these projects have been jug gled by the council for many weeks. The widening of Peachtree street its entire length was mixed in the matter, too, at first, but that was dropped some time ago. Persons owning property on Ivy street have offered to enter a contract with the city to advance $30,000 to bear the Immediate cost of the work. The county commission has agreed to do the grading. The property owners do not require that the $30,000 be repaid un til the city sees fit. May Veto Georgia Avenue Plan. Representatives from the south side began to protest that Georgia avenue should be improved first. It Is possible that Mayor Winn will veto the Georgia avenue project. It takes money from other streets and in curs a moral obligation on the city for an additional appropriation next year. The city has outlined a boulevard from West End to Grant park, which In cludes Georgia avenue. The county commissioners have agreed to help In the work. Both these big Improvements still are much iinsettled. This question today is puzzling city officials. The puzzle grows out of the city health law requiring screens in restaurants, fruit stores and other such places. Peter Brown, Greek proprietor of the Arcade restaurant, 38 Peachtree street, raised the question and has set the wise ones guessing. Brown holds that plate glass doors are screens—better even than wire screens—and hence has been operating his Peachtree restaurant without the customary wire screens. The city ordi nance stipulates that "screens shall be provided to keep out flies and other insects. There’s no provision as to the kind of screens to be used. Brown says the dictionary describes a screen as a “shield.” and that, there fore, plate glass serves the purpose. Dr, Van Dyke’s View Different. The first to take issue with Brown’s construction of the law was Dr. Arthur H. Van Dyke, chairman of the sanitary committee of the city council and member of the board of health. Dr. Van Dyke construes the taw on screens to mean wire screens pure and simple, and accordingly instructed Health In spector Wasser to make a case against Brown. “And make a case against him every day his place is without screens, too. He can’t defy the law this way,” added Dr. Van Dyke. W hen Inspector Wasser informed Brown he would have to make a case against him, the restaurant man agreed to remove the plate glass and substi tute wire screens rather than to face a long fight in the court to test the point. In the meantime, Brown substituted wire screens, and they are now doing regu lar duty. When Brown was arraigned for trial yesterday afternoon in police court, In spector Wasser explained the whole situation to Recorder Pro Tern Pres ton and said that Brown had removed the plate glass within an hour and a half after being notified. Brown Is Dismissed. Tlie inspector also explained that after making the case he consulted City Attorney Mayson and asked him for a ruling on the screen law, as to its meaning. The city attorney held that wire, cloth or anything that would keep out flies would be construed as a screen, but said he hardly thought plate glass doors would come under that head. Judge Preston said Brown had done all that any person could do by remov ing the plate glass and substituting wire screens, and dismissed the case. Asked by the inspector for his rul ing on the law. Judge Preston also held that plate glass doesn’t exactly fit the meaning of the law, although he ad mitted that literally plate glass Is a screen and a good one at that. Judge Preston said the law evident ly contemplated a screen with ventila tion, but a close perusal of the ordi nance failed to reveal any reference whatever to ventilation. Brown’s contention as to plate glass doors is based mainly on the Idea that such doors measure up to all require ments of the law—keeping out flies and also other insects.
