GEORGIA HANGING HALTED BY PHONE Governor Grants Negro Slayer Ten Days Respite at the Eleventh Hour. .’ack Baldwin, a negro sentenced to be hanged at noon in Stewart county today, was respited for ten ays by the gov ernor al 11:30 o’clock this morning. It wa s'necessary to call the sheriff over long distance telephone, in order to head off the execution. Baldwin's case was heard before the prison commission Tuesday, and his ap plication for life commutation denied. To day his lawyers, at the last minute, made an extraordinary motion before Judge Lit tlejohn for a new trial, which the judge denied. Judge Littlejohn agreed to sign a fast bill of exceptions to the supreme court, however, and it was upon that showing, made by the governor by wire, that the respite was issued. The sheriff of Stewart can not get the official papers before tomorrow, but, upon receipt of the governor's telephone mes sage. he called off the preparations for the binging, which had been set for 12 o'clock. JUDGEA.W FITeTtO ANSWER CONTEMPT CHARGE IN PERSON The rule for contempt issued by the court of appeals against Judge Augus tus W. Fite, of the Cherokee circuit, will be called for a hearing tomorrow morning at 10 o’clock. Judge Fite will answer the rule in person, and undertake to purge himself of the charge of contempt set up against him by the higher court. This case grew out of some recent severe criticisms of the court of ap peals by the judge of the lower court, following a second reversal of Judge Fite in the same case. IL—Warren House, who caused the death of Val entine Lukowski, a fellow workman, a few months ago, while playing a prac tical joke, has begun the serving of an unusual sentence imposed by Justice Marcus in the state supreme court here. The sentence places House in charge of a probation officer for an indefinite period and compels him to pay $3 a week toward the support of the family of the dead man. until the children are able to support their mother. It is es timated that the fine will cover a pe riod of about ten years, amounting in all to more than $1,500. House turned a compressed air hose on his fellow workman in fun. IND., Oct. 11.—The name of Samuel Gompers and the American Federation of Labor went into the official record of the dynamite conspiracy trial in Federal court for the tirs| time this forenoon. When Senator Kern objected to this. Attorney Noel said: “The prosecution will show that Samuel Gompers did have something to do with the defense of this conspiracy in California, if nothing else."
