REBURIALDFMAN FOUGHT IN COURT Because the late Dr. Chapman Powell had decreed that his body should re main buried in the little two-acre cem etery of Hardeman Primitive Baptist church, on the Paces Ferry road, heirs of Mrs. A. K. Houston, deceased daugh ter of Dr. Powell, have joined with heirs of the late Mary J. Rucker in op posing the erection of the Rucker mau soleum in Oakland cemetery as the last resting place of Dr. Powell and his im mediate family. Joining the Rucker legatees, ten heirs of Mrs. Houston, headed by A. B. Houston and Dr. W. J. Houston, filed suit in superior court today to set aside the features of the Rucker will relative to the reinterment of the bodies of Dr. Powell and his wife, Mrs. Elizabeth Powell. The petitioners asserted that Dr. Powell bought the land upon which the Hardeman cemetery is located in 1840 and set aside two acres for a burial ground. It was bls wish, the suit re lates, that both he and his wife be burled there and this wish was carried out to the letter. When the will of Mrs. Mary J. Ruck er was probated it was discovered that she had set aside $15,o»o from the es tate to be used in the erection of a granite vault in Oakland cemetery' as a burial place for herself, her late hus band and her father and mother. Mrs. Rucker’s heirs immediately filed pro test. citing practical reasons as the cause of their action. The suit filed today by the heirs of Mrs. Houston, a sister of Mrs. Rucker, Is based upon sentimental grounds. It is asserted that Dr. Powell preferred the Primitive burying ground to any other and that his last wish should be respected.
