Mrs. Serrett affirmed .that several days before the Wilson boy shot young Herndon he had threatened her son with the same rifle. Winn asserted that the boy chewed to bacco and srpoked. Some of the testimony tended to shots that young Herndon and Wilson were not playing a game when the shooting occurred, but Herndon was passing the Wilson house and the Wilson boy shot, him from the porch. Mrs. Wilson ad mitted she was forced to leave the boy at home with her aged mother during the day while, she was at work.
