Rev. Marion Capps, a former Mot ho- j
dlSt preacher, has filed an appeal
to the State Supreme Court from a
sentence of death imposed upon him
by a Sebastian County Jury. He was j
convicted of burning to death three j
of his children. Evidence at the trial j
was that the children were tied jn
bed, which was saturated with oil, J
and the house fired.
Capps was convicted on the testi- j
many of two older children, who es
caped, but who, it is alleged, have
since declared they swore falsely
against their father.
