Bowen, the cor ner of the postoffice building at For syth and Poplar streets w'ould never have sagged had the structure been built on the solid rock which sup ports the Healey Building, the Ho tel Wlnecoff and other Atlanta build ings. The postoffice was built on a reinforced concrete foundation some four feet below the basement floor, and now a slight depression has cracked the exterior stone walls and the Interior plaster walls of the Fed eral Court. Mr. Bowen thinks half an Inch of sinking would produce this result, and that the building corner has no! dropped as much as three inches. He says there Is no danger. At the Wal ton street entrance to the postoffice there is a slight depression that has likewise caused the stone to crack. Building Permits Sought. Application has been filed with the Building Inspector for a permit to erect a three-story apartment house at No. 1235 Peachtree street, south east corner of Peachtree circle and in Ansley Park, at a cost of $30,000. Barlow, millionaire promoter and the central figure In a dozen deals that have astounded financiers by their boldness, will pause in At lanta Wednesday on his way from Cuba to New York to take up the fight for the custody of his daughter, Madeline. 8 years old, who ls living with her mother, Barlow’s divorced wife, at No. 219 West Peachtree street. Barlow is known as a fighting man and he has given his word that he will have possession of his daughter. He does not propose to relinqulsn the legal battle until custody is re stored to him by the court which once before awarded him possession. He Is going to New York to swing a big railroad deal, but this can wait, he declares, If he llnds it necessary to stay In Atlanta to contest the ac tion of his former wife, Mrs. Edith P. Barlow, who has become a profes-" sional masseuse in Atlanta since her separation from him. Climax hxpected in Suit. The pretty little girl has been the cause of a number of sensational in cidents, not the least exciting of which was an alleged attempt on the part of the mother to spirit her out of a hotel at Lumpkin, Ga., and catch a 3 o’clock morning train out of town. The fight, which has been waged with varying fortunes, promises to have Its climax when the present lit igation comes to an issue. Barlow made charges of immorali ty against his wife w hen he obtained his divorce from her in 1911. These may be revived and form an impor tant part of the proceedings when a decision ls being reached as to who is the more fit to have the care and training of the youn- child. Barlow’s career, w'hich finds him negotiating big business deals one day and fighting for the custody of his little girl the next, reads like a romance. He has risen like a meteor In the heavens of finance and he has fallen even more suddenly. His fail, however, apnears to have been the rsult of unfortunate and unavoidable circumstances rather than of poo* business judgment. Fought Way to the Top. As a youth he had few educational advantages. He simply fought his way upward. He was a Stewart County (Ga.) hoy. .. few years ago he went to Florida. It was not long before he w'as worth thousands of dollars and was the owner of a great acreage of orange groves. Just as he was about to reap the results of his Investment misfortune sent an Icy blast on his orange trees and he was made a pauper almost in a single night. Being a fighter, he was not discour aged. He went to Cuba. Sensing the inflation of values that would follow the Spanish-American War, he ob tained options on large tracts of land about Havana. The sale of these has made him rich again. Now he ia rated at several times a millionaire. He has the confidence of financi.-rs In New York, Paris, Berlin and all the large financial centers. He es says deals that would appall men of less courage and boldness. Just now he is promoting the con struction of a railro„ in Cuba. It is the purpose of his visit to New York to Interest men of money in tlie prop osition. He had thought he might go on to Paris, but the tangle of litiga tion which has arisen over his child may prevent this. Barlow has been three times mar ried. His first wife died. His sec ond, who now Is living In Atlanta with their child, he met in Boston about 1903, when he was there on ono of his business missions. Their mar ried life was not entirely happy, and In 19X0 they separated, she returning to Massachusetts with the child and he remaining In Cuba. He brought suit for divorce against her in 1911, coming to Stewart County, his old home, to do It. He alleged cruelty and immoral conduct. The question of jurisdiction was bitterly contested, but It w'as decided that the Stewart County Superior Court had power to adjudicate the couple’s differences, and a total 11- vorce was granted. Barlow, in lieu of alimony, paid a lump sum of money to the defendant and deeded certain lands in Stewart County and other places to her and their daugh ter Madeline. He was given the care, control and custody of the girl, with the agreement that she should be al lowed to visit her mother at reason able intervals. He married Mrs. Maud Carter, a widow and a sweetheart of his boy hood days, soon after the decree was granted Early last month, when the third Mrs. Barlow was visiting In Lumpkin, the divorced wife came to the same hotel and asked the privi lege of taking the child with her on a visit. Kidnaping Attempt Charged, The wife cabled Barlow, who was in Cuba. He promptly and briefly re plied, "No." The mother then asked if she might not have the child with her In her room at the hotel. This request readily was granted. The hotel guests were startled about 2 o clock the next morning by the alarm that the mother stealthily had left the hotel and had taken her daughter with her. Officers at once were sent to the railroad station, where a train was due at 3 In the morning, and all of the garages were watched to prevent the woman getting out of town by automobile. The next day she was found in one of the homes In the town, to which she said he had gone with no Intention of kidnaping the child. Mrs. Maud Barlow at once obtained An attorney and Instituted habeas corpus proceedings. The habeas cor pus not only was denied by the Ordi nary before whom the case was heard, hut the Superior Court virtu ally was overruled by the perm i- nent award of the child to its own mother, Mrs. Edith Barlow. Father Hurries From Cuba. Barlow hurried from Cuba to the United States and to Atlanta, where he engaged Burton Smith and the firm of Little, Powell, Hooper Sz Goldstein to look after his interests. The Ordinan* who decided against Barlow and his present wife in the habeas corpus proceedings strangely enough is an uncle of Frank A. Hooper, one of the attorneys for Bax- low.
